I want to file a complaint against Public Defender Kevin Shea 651-346-1528 for sabotaging my criminal cases. Shea has not provided me any paperwork for 19AV-CR-20-8547, 19AV-CR-20-8569, 19AV-CR-20-8570, 19AV-CR-20-8571, 19AV-CR-20-8572, 19AV-CR-20-8573, 19AV-CR-20-8574, 19AV-CR-20-8575. And all of these allegedly have active warrants. How am I supposed to defend myself against these charges or prepare for trial unless I have my case files from these cases? And this is not the only time Shea has made sure that I don't have my paperwork. Shea doesn't want to give me the paperwork for Case No. 19HA-CR-19-2768 and 19AV-CR-19-11836 State of Minnesota vs Jessica Danielle Hartger either. How an I supposed to prepare for trial if I don't have my evidence? Plus, Shea has made no effort to obtain a statement from my witness Madison Elkins. In fact, Shea hasn't submitted a witness list. So how can I trust that Shea will call Madison to the witness stand? I can't. I have no confidence in Shea at all. Finally, Shea has made no effort to obtain my cell phone data. My cell phone data should have ping data that shows that I was nowhere near the scene of the alleged crime. Who would trust Shea after his sabotage of my cases? If Shea is going to continue to ignore my phone calls, ignore my emails and ignore my instructions, then I want him off of my cases. Plus, I am demanding that you launch an administrative investigation into this matter.

I want my case files and all my evidence/discovery from all my open criminal cases immediately file shared to me via your Alfresco file share software. Plus, I want a copy of your latest State of Minnesota Board of Public Defense General Office Policies emailed to me immediately. AFFIDAVIT OF WITNESS MADISON A. ELKINS JESSICA DANIELLE HARTGER DEFENDANT. I, Madison A Elkins, submit this sworn statement in the defense of the DEFENDANT, Jessica Danielle Hartger. My current occupation is Special Education Assistant, I am 24 years old, and my current address of residence is 235 Nathan Lane N, Plymouth, Minnesota 55441. On the morning of August 13, 2019, shortly after 10:00 am, Jessica Hartger arrived at my apartment complex, as The Hartgers were in the process of recently moving out of the same apartment complex and were paying for an onsite storage unit. With my assistance, Jessica Hartger was planning on gathering things from that day to finalize The Hartger’s recent move. When Jessica arrived to the complex as noted above, I walked down to the parking lot to meet her. We proceeded to have a smoke while chatting over coffee. Within an hour or less (approx.) of our chat, Jessica's phone rang from an unknown number. She answered the phone and the caller identified himself as a police officer from Lakeville, Minnesota. He proceeded to ask her about her whereabouts that morning and informed her that they had received a complaint from her ex-boyfriend, Cody Myers with whom she shares joint custody of their now 6-year-old son, C.A.M. The Lakeville Police Officer stated Mr. Myers complaint was that “Jessica had broken into Mr. Myers apartment complex that morning and attacked him.” Jessica complied with the Officers questioning and was informed she would be mailed a citation. We both sat in awe, as clearly this report was indeed made with malicious intent. This is not uncommon behavior for Mr. Myers, as Jessica Hartger and I have been friends and neighbors for 1+ year(s) in which I have witnessed on multiple occasions Mr. Myers falsify police reports to harm the defendant herein and or to gain an unfair advantage in their reoccurring Custody Dispute(s). It is to my own witnessing that based on the timeline that was given by Mr. Myers and the Lakeville Police Department, it is not possible that Jessica could have been to Mr. Myers apartment in Lakeville the same morning and still gotten Kenneth to work on time in St. Louis Park, and arrived at my apartment by a little after 10:00 am. Jessica was with me for the remainder of the day, either in my apartment/patio or organizing her storage unit until Kenneth was ready to be picked up from work. I hereby state that the information above is true, to the best of my knowledge. I also confirm that the information here is both accurate and complete, and relevant information has not been omitted. Guess who quickly contacted me after I sent you and Terry Nemmers of Lion New an email detailing how Public Defender Kevin Shea was sabotaging my cases? Did you guess your saboteur Kevin Shea? I have reason to suspect that I have clear, precise and unquestionable proof that your saboteur Mr. Shea started his retirement plans when I was saddled with him way back in 2019. Oh, and guess who didn't include any of my missing evidence in his email? Did you guess your early retiree your saboteur Mr. Shea? Your saboteur Mr. Shea did bring up an interesting fact about evidence on seven (7) discs. Can you guess what evidence was missing from those seven (7) discs? If you guessed the cellphone ping data that clears me of any alleged crime, then you are right again! My case should have been dismissed back in October of 2019. Yet, here we are in the middle of April of 2021 and this joke of a case is still dragging on because of the saboteur Shea. Your saboteur Shea has not filed a motion for sanctions nor has saboteur Shea demanded a contested omnibus hearing that has addressed that missing ping data.

Nor has saboteur Shea assured me that his private investigator is on his way to take a statement from my key witness. Madison Elkins. Apparently saboteur Shea doesn't want Madison on the record to say that she was with me at the time of the alleged crime. Which is again why I do not trust your saboteur Shea. Oh and if saboteur Shea wanted off my case so bad, then he should have filed the proper paperwork to get off the case. Yet, saboteur Shea didn't even do that, did he? I want my evidence file shared to me immediately! I want saboteur Shea off my case immediately! I want an administrative investigation started immediately! I plan to be very vocal about this!

I became aware of the warrants and advised you of them. Until you make a court appearance on those files, apply for the public defender and have an attorney appointed, the prosecutor does not provide discovery to the public defender’s office. I have provided to you all the discovery from the prosecutor on the matter set for trial that has been received by my office, including all recordings and computer discs. The next hearing before Judge Awsumb is a pretrial set for a remote hearing July 7th at 2:00p.m. The matter is set for trial beginning June 28 at 9:00a.m. I have not responded to your recent emails directed to me, including your email dated 3/17/21 when you advised me I was fired as well as accusing me of treason and human trafficking. Finally, I am advising you that I am retiring, effective May 1, 2021 and that a different public defender will be appointed to your case if you still wish to be defender by the Public Defender. Kevin Shea, Public Defender: Your honor we would oppose any modification to Ms. Hartger’s release conditions. Un this was uh an isolated incident while she has been on release. And frankly to put this in a bit of context it looks like this recent series of events occurred when Ms. Hartger filed a motion in her family law case. I believe on October 22nd requesting to appear by a Zoom. Because she uh advised the court that she was under quarantine for COVID-19. It was shortly after that initial filing that she made that she was contact by judge Offermann’s law clerk. Ah given instructions as far as the Zoom call for that particular day. At some point there was an inquiry made regarding whether or not a report from the assigned guardian guardian ad litem had been filed. Because Ms. Hartger hadn’t seen it. I think that she was provided with a copy shortly thereafter. Ah My understanding is that …. She was upset that there was references being made in the report to her having outstanding warrants on these new misdemeanor that have been filed. That was the first time Ms Hartger heard anything about that. Uh, frankly judge these misdemeanors filed by uh Campbell Knutson law firm, the City Attorney’s for Burnsville and Lakeville all deal with alleged alleged incidents that occurred a year ago or last Spring. That I believe have been addressed uh either formally or informally by this court in this case. Um some of these incidents ah were ah occuring almost simultaneously with various ah arrest request the state has made in this case in the past. And and on October 19th and 20th the City Attorney filed five excuse me filed eight complaint warrants. None of which contain Ms Hartger’s correct address as where she could be located. All made allegations that she couldn’t be located and that a warrant was necessary. That was Ms. Hartger’s knowledge of these warrants.
