I have reason to suspect that City of Eden Prairie City Attorney Jesse Berglund (Hereinafter Berglund) is conspiring with City of Eden Prairie Chief of Police Greg Weber (Hereinafter Weber) to illegally withhold subject data aka criminal investigative data aka Discovery from me for Case No. 27-CR-20-4801 State of Minnesota vs Kenneth John Hartger. Pursuant to Mn Statute 13.82 and Dept. of Administration’s Advisory Opinion 18-005, Berglund and Weber had only ten (10) days1,2 to provide me with this readily available, free, electronic data after I submitted my signed City of Eden Prairie Consent To Release Private Data form via email on Sunday, June 28, 2020 at 5:03PM. Neither Berglund nor Weber have provided me with my subject data in the required ten (10) days.

I am also aware that it is Berglund’s and Weber’s known mandatory, nondiscretionary, ministerial duty of the office or employment within the time or in the manner required by law3 to provide me with my subject data for Case No. 27-CR-20-4801 State of Minnesota vs Kenneth John Hartger. For some strange reason the City of Eden Prairie has released some but not all of the confidential data for 27-CR-20-4801 to my estranged wife Jessica Hartger (Hereinafter Jessica) and a blogger named Terry Dean, Nemmers4,5 (Hereinafter Nemmers).

According to Nemmers, the readily available, electronic data for Eden Prairie confirming the alleged warrant is magically and mysteriously missing. I certainly want the missing subject6,7 data from Eden Prairie that shows when Weber’s officers confirmed the warrant that they used to arrest my estranged wife, Jessica and myself, to justify breaking out my window8 and to justify towing9 my car. Because according to the data that Nemmers provided me, Weber could have deescalated10-11 the entire incident by providing myself and my wife, Jessica with a physical copy of the warrant. Also, Nemmers informed me that there was a female officer on the scene. That female officer could have stepped in to again deescalate the incident on 02-21-20. For some strange reason neither Weber nor the officers on the scene could fall back onto their expensive and time-consuming work-related continuing education to deescalate a simple incident involving warrant.

Nemmers has been assisting my estranged wife, Jessica, in obtaining her subject data from a variety of law enforcement agencies. And that data has caused my wife to come to the reasonable and logical conclusion that she has been a victim of false police reports12,13,14,15,16,17 filed by both Cody Austin Myers and Dakota Co. Judicial Officer Ann Offermann. Nemmers also provided me with public data that shows Offermann’s fellow judicial officers love to false police reports based on a law that was determined to be unconstitutional18,19. See attached. Also, it would appear that even in high-profile criminal cases there are problems with Dakota County warrants20,21.

I have reason to suspect Berglund’s and Weber’s motives for not providing me with my subject data are the following:

1. To cover up the false police reports filed by Cody Austin Myers and Dakota Co. Judicial Officer Ann Offermann.

2. To force me to plead guilty or force me to be found guilty at trial without ever receiving all my evidence for Case No. 27-CR-20-4801. Page 1 of 5

I also have reason to suspect both Berglund and Weber are aware that my estranged wife, Jessica has submitted additional evidence into 19AV-CV-19-2297 & 19HA-CR-19-2768 which tends to prove her innocence.

If Berglund and Weber had a legitimate criminal case against me, then they would have complied with the law that they claim to uphold. Apparently, Berglund and Weber can only win criminal cases by illegally withholding evidence from the defendant. FYI: My arraignment is on 08-26-20 at 1:30PM.

You do agree that I have a right to possess my evidence at least ten (10) days prior to that hearing, don’t you? So what do you plan to do about your corrupt officers of the court Eden Prairie City Attorney Jesse Berglund and City of Eden Prairie Chief of Police Greg Weber? 11. KENNETH refused to open the door and requested to see the warrant for JESSICA. … KENNETH again requested to see the warrant. I advised KENNETH that if he continued to refuse to open the door he would be charged with obstructing. KENNETH refused and stated he would not open the door until a warrant was provided to him. 12. Judge Offermann expressed concern because the emails Hartger seems to be very escalated in her behavior and threat of taking action. In one of the emails Hartger claims that the court “unlawfully kidnapped” her son Colton Myers. Hartger then states that this type of abuse by the court “leads people to alternative extremes”. In many of the other emails Hartger challenges parts of the case against her, stating that she is being being unlawfully investigated and harassed by the police and courts. 13. Background: Jessica Hartger sent a long rambling email referencing several Dakota County Judges. (copy placed in Court Security Bulletin folder) The message threatens civil action against judges for decisions made during recent hearings involving DANCO by ex-boyfriend and custody concerns of her son. In her message Jessica feels that the County is financially profiting by keeping her son from her. She does not make any overt threats; however, she writes that her constitutional rights will no longer be violated and that she will make her lack of trust of the judicial system be known nationwide. 15. On 02-21-2020, I Deputy Scheffknecht, was assigned to the Bailiff Station at the Division 2 Government Courthouse in Hastings, MN. I was notified by Sergeant Wilkerson about potential threats made toward Dakota County Judges by an individual identified as Jessica Danielle Hartger DOB/ 1992-01-15. After reviewing emails sent by Mrs. Hartger, text messages, and Police Reports forwarded to me, at this time, Mrs. Hartger does not appear to make any threats towards the judges that are criminal in nature. On February 21, 2020, law enforcement was forwarded an email that Defendant sent to a family supervision service that the Honorable Ann Offerman was vacating the HRO against the victim in this case and was also lifting a family court order granting the victim temporary custody of their joint child. See Confidential Exhibit A (attached). Neither of these orders were being lifted, and when Judge Offerman’s law clerk corrected Defendant’s misrepresentations in an email, Defendant proceeded to send emails to numerous parties including the Honorable Kathryn Messerich, that were harassing in nature and threatening. Specifically, Defendant stated, “DO I NEED TO FLOOD DAKOTA COUNTY WITH PEOPLE? BECAUSE WERE READY WHEN YOU ARE.” On the same date, Defendant wrote a post on Twitter, which referenced the email from Judge Offerman’s law clerk. See Confidential Exhibit B (attached). 17. The advent of social media has given us a window into our fellow citizens’ views that we did not have before. Drunken political tirades like Taylor’s once were confined to living rooms or pool halls. They now can be seen by everyone, everywhere. The First Amendment protects them either way. On May 17, 2018 I met with Judge Knutson to speak with him about this investigation. I provided him information about Twitter's public portal which allows a private citizen to request content be removed if they feel it is defamatory or threatening in nature. I suggested that if he made a request as a private citizen it may hold more weight with Twitter as requests from law enforcement have been unsuccessful. This investigation will be closed as inactive. Timothy Holmes (27-CR-17-23450) & Detective Travis Serafin Dear Chief DeMann, I would like to bring to your attention a matter of concern to me involving one of your detectives that occurred at a suppression hearing involving a serious case, Timothy Holmes. Mr. Holmes was charged with Third Degree Murder and First Degree Drug Sale after providing drugs to someone who died of an overdose. The investigator assigned to this case was Travis Serafin. During the course of the investigation, he applied for a search warrant to search Mr. Holmes and his residence. That search warrant (Exhibit C) was signed by Judge Jay Quam. As you can see, Detective Serafin never requested to search the vehicles at that residence, and the authorization to search the vehicles was specifically crossed out by Detective Serafin. Detective Serafin apparently realized that he forgot to include the vehicles in the first search warrant so he prepared another search warrant (Exhibit B) which was identical to Exhibit C in every respect except that he also requested to search any vehicles associated with the residence (he requested to search for other things that are not relevant here). What he did then, from everything I can tell from reviewing the two search warrants and listening to his direct and cross-examination, was take the signed search authorization from Judge Quam and then simply added that page to the new search warrant request without bringing it to Judge Quam for review or signing. As you can see from the two search warrants, the search warrant affidavit form signed by Judge Quam is identical in every way, including the judge's signature, Detective Serafin's signature and the date. You can also see that the search warrant authorization pages of the two search warrants are also identical, including the fact that the authorization to search the motor vehicles was still crossed out (crossed out by Detective Serafin) which is further evidence that hesimply made a copy of the first search warrant authorization and affidavit pages and included them in the second search warrant which was never presented to Judge Quam. What this means is that he searched the vehicles at that residence when he knew he did not have prior judicial authorization and mislead everyone by representing that he got Judge Quam's authority to search the vehicles. Maybe Detective Serafin will have another explanation for what happened, and I'll leave it up to you to decide what happened in this case. I do not think Detective Serafin has appeared in my courtroom before, and I have nothing against him personally, but it's important that things like this do not happen in the future. The parties knew I was prepared to suppress the evidence (drugs) found in the car and the case eventually settled. Thank you for your attention to this matter.
