All LEIN operators on all shifts are responsible to validate warrant and injunctive order entries. They should be done daily, as time permits, until the list has been completed. When LEIN operators validate warrant and injunctive order entries, the records on the validation list having an asterisk (*), indicating that it is the first time that entry has appeared on a list, need only be checked for accuracy and completeness. The information on the warrant or injunctive order should be checked against the information that is currently entered in LEIN and information added or corrected as needed. Older records should be checked not only for accuracy and completeness, but also to assure that the warrant/order is still active. Warrants that are ten years old or older should be canceled and returned to the court of origin for them to establish validity. Warrant entries, especially those that will go into NCIC with extradition, need to be “packed”. This refers to entering every available piece of information, such as fingerprint codes, court tracking number, social security, SID, FBI, driver’s license, prison, and personal identification numbers, aliases, scars, marks, tattoos, and physical deformities. Much of this information is available by running the identification segment only on a criminal history record (this will not require the use of a criminal history request form as only the identification portion is received and not the entire criminal history. SYNOPSIS OF EVENTS This report details the investigation of defamatory social media posts which mention Dakota County Judge David Knutson. On May 17, 2018 I met with Judge Knutson to speak with him about this investigation. I provided him information about Twitter's public portal which allows a private citizen to request content be removed if they feel it is defamatory or threatening in nature. I suggested that if he made a request as a private citizen it may hold more weight with Twitter as requests from law enforcement have been unsuccessful. This investigation will be closed as inactive. Memo TO: File – In Re the Custody of: C.A.M. - Myers and Hartger – Court File Number 19AVFA15-2677 FROM: The Honorable Ann Offerman On February 20 and 21, 2020, Respondent Jessica Hartger sent various emails to the Court’s law clerk, opposing counsel, the Chief Judge of the First Judicial District, and others. Some of these emails included oblique threats toward the Court. After consultation with the Chief Judge, I reported these threats to law enforcement listing the Court as a victim in law enforcement records. Subsequently, law enforcement informed the Court that Ms. Hartger was posting about the Court on social media. Law enforcement advised the Court that Ms. Hartger’s location was unknown and that she was subject to a bench warrat in a felony criminal matter. The Court viewed Ms. Hartger’s public social media to determine if she was making further threats toward the Court or its staff. The Court deemed this to be an emergency and reasonably believed that no party would gain a procedural, substantive, or tactical advantage as a result. Any information learned from social media posts attributed to Ms. Hartger will not be used to render a decision in this matter. On April 6, 2020, law enforcement informed the Court that Ms. Hartger was again subject to a bench warrant, her whereabouts were unknown and she had posted threatening statements related to the Court on social media.
The charges and warrant for Grazzini-Rucki’s arrest were filed under seal because of police fears that she would go into hiding. But a reference to the warrant was accessible to the public on a Dakota County Sheriff website since at least last Friday. Dakota County Sheriff Tim Leslie blamed a glitch for allowing the display of records that were supposed to be kept under seal. The record was taken off the website Tuesday afternoon. The original FOIA request asked for the Kent County Sheriff’s Department Policy and Procedure manual. If you wish to have a copy of that, you will need to ask the sheriff’s office. However, I have attached a copy of the P&P manual for the prosecutor’s office as well.
