Dear Judge Awsumb:

The State submits this letter requesting that the Court require Defendant Jessica Hartger to appear in person for the pretrial hearing currently scheduled for June 7, 2021, at 2:00 p.m. There are multiple reasons for this request.

First, the State has learned that Defendant made a recording of a review hearing held in this case on November 5, 2020 and posted the recording on YouTube on November 6, 2020. Law enforcement verified that this recording was still on YouTube as of April 29, 2021. The video was posted from the YouTube account of “Jessica Hartger,”and it is apparent in the recording that Defendant is the person making the recording. This recording was made despite the Court’s explicit prohibition at the start of the hearing that no participants were permitted to record or screenshot any part of the hearing. Law enforcement’s documentation of this recording can be provided to the Court if it so requests. Requiring Defendant to appear in person on June 7, 2021, would ensure that she does not violate the Court’s order by making a recording of the proceeding. [Note: LEO has been monitoring Hartger's social media accounts long before 11-06-20, haven't they?]

Second, the State has reason to believe that Defendant no longer resides in Minnesota and may be residing in the State of Colorado. While Defendant’s conditions of release do not prohibit her from leaving the State of Minnesota, the State does have concerns that Defendant may not return to Minnesota for future court proceedings, including the jury trial currently scheduled for June 28, 2021. This concern is heightened by the fact that Defendant has numerous misdemeanor warrants for her arrest that have been active since October 2020. [Note: Hartger's social media posts placed Hartger in Colorado way, way, way back in October of 2020, didn't they?]
