I have reason to suspect that Minnesota licensed Maslon LLP attorney Barry A. Gersick 1,2,3,4 is advising his client Goverage President Tony Webster5 on how to violate federal laws by willfully refusing to provide me with the most recent Form 990 for the nonprofit Goverage. Neither Gersick nor Webster provided me with the Goverage Form 990 in the required (1) one day 7,8,9 time period pursuant to StayExempt.irs.gov. According to the IRS, the most recent Goverage Form 990 filing is from 2019 10 .
It is a violation of Gersick‘s law license agreement for Gersick to engage in “Rule 8.4: Misconduct. It is professional misconduct for a lawyer to: (b) commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects; (c) engage in conduct involving dishonesty, fraud, deceit, or misrepresentation.” I have reason to suspect that I have clear, precise and unquestionable evidence of Gersick engaging in Rule 8.4 Misconduct. It is very clear from my evidence that both Minnesota licensed Maslon LLP attorney Barry A. Gersick and Goverage President Tony Webster think and act like they are above the law. I believe that attorney Barry A. Gersick should have his license revoked for this violation. I also believe that the nonprofit Goverage should have it’s charity status revoked. I expect that you will forward my complaint and the results of your investigation to the IRS.
Timeline:
1. 03-01-21 at 2:14 PM: Formal request for Goverage Form 990 submitted via email to Gersick & Webster. No response in the required (1) one day. Form 990 for Goverage not provided.
2. 03-04-21 at 9:36 AM: Status request Goverage Form 990 submitted via email to Gersick & Webster.
3. 03-04-21 at 9:41 AM: Gersick responds with stonewalling tactics via email (Denial – Complete Denial). Form 990 for Goverage not provided.
4. 3-04-21 at 10:20 AM: Nemmers requests of Gersick & Webster via email that they provide a clarification and a time when Goverage Form 990 will be emailed to Nemmers.
5. 03-04-21 at 10:32 AM: Webster responds via email with stonewalling tactics (Diversion – Counterattack) and with wild, outrageous and unsubstantiated, defamatory statements about Nemmers. Form 990 for Goverage not provided.
6. 03-04-21 at 11:00 AM: Gersick responds via email with a stonewalling tactic (Denial – Selective Denial). Form 990 for Goverage not provided.
Evidence: Emails submitted by Nemmers to Gersick & Webster and emails received by Nemmers from Gersick & Webster attached.
Means Motive & Opportunity: Nemmers was forced to report frivolous and malicious litigant Goverage President Tony Webster to Minneapolis Police Chief Janee Harteau (01-06-17) and to Hennepin County Sheriff Rich Stanek (09-06-17) after Webster engaged in a scheme to harass Nemmers with wild, outrageous and unsubstantiated, defamatory perjured statements that he filed into

the Hennepin County District Court. One of Webster’s defamatory perjured statements was that Nemmers had “hacked” 11 Webster’s Twitter account. (Note: At no time was Nemmers contacted by law enforcement for the imaginary crime of “hacking” Webster’s Twitter account. Nor did Twitter ban Nemmers from Twitter for the imaginary crime of “hacking” Webster’s Twitter account.) Webster’s scheme included duping the Hennepin County District Court into waiving the filing fee 12 for Webster’s Strategic Lawsuit Against Public Participation (SLAPP) suit that he filed against Nemmers. Webster’s false representation to the court was that Nemmers’ alleged actions were criminal. Webster bragged about his scheme online while he continued to run a smear campaign against Nemmers. Nemmers countered by starting an education program in which he provided individuals with accurate public information. Webster then retaliated against Nemmers by filing false police reports 13 against Nemmers. However, Nemmers was never contacted by law enforcement in regard to Webster’s false police reports. Webster has never apologized to Nemmers nor retracted his wild, outrageous and unsubstantiated, defamatory perjured statements 14 about Nemmers. Instead, Webster began to sanitize the evidence of his harassment of Nemmers from the Internet. Which brings us up to present day. Goverage President Tony Webster’s conspiracy with Maslon LLP attorney Barry A. Gersick was designed to harass and intimidate Nemmers into not requesting and not obtaining public data on Goverage. Instead, Nemmers simply documented Gersick’s and Webster’s harassment, their intimidation tactics and their willful refusal to comply the IRS’s Required Disclosures for Nonprofits.

Anfinson wonders whether things might have worked out better for everyone had Webster filed a narrower request at the beginning. “It was a very difficult, complex, time-consuming, expensive request compared to most requests for public records, in relative terms at least,” Anfinson said. “I would call it a data bomb.” As a longtime news-media attorney, Anfinson is, like Webster, a champion of public data access. But he also considers himself a realist. “There are people in the data practices and open records world who think that the only function of a government agency is to wait around for a public records request,” Anfinson said. “That’s not reality.” Blunderbuss-style data requests threaten to provoke resistance—not compliance—from government agencies to data requests, Anfinson said, possibly skewing access for both the news media and the general public.
