Today, September 2, 2014, you requested information from the City of Wells Police Department via email. Under the Minnesota Government Data Request Practices Act (Minnesota Statue 13) and subsequently required under the Federal Freedom of Information Act, it is the responsible authority’s “duty to respond to the request.”

Attached is the City of Wells Data Request Policy. This policy strictly follows Chapter 13 of the Minnesota Data Practices Act. We will not process your request until you complete and return said form and agree to any charges incurred. Once you do so, I will gladly address your data request.

What MDE Does Not Include in Copy Charges As a courtesy to our community, MDE never charges for the time of the data practices compliance official or other data practices staff, even when these individuals are substantially involved in searching for, retrieving and making copies of data. In addition, MDE does not charge for the first two (2) hours of program staff time spent searching for, retrieving and making copies of data. MDE cannot and does not charge a fee for separating public data from private data, and this includes preparing summary data from private or confidential data. Subd. 2. Procedures. (a) The responsible authority in every government entity shall establish procedures, consistent with this chapter, to insure that requests for government data are received and complied with in an appropriate and prompt manner. 13.05 DUTIES OF RESPONSIBLE AUTHORITY. Subd. 12.  Identification or justification.  Unless specifically authorized by statute, government entities may not require persons to identify themselves, state a reason for, or justify a request to gain access to public government data.
