Re: Complaint against Sibley Co. Attorney David Schauer – Illegally withholding malicious prosecution data for Michael Hartmann – Case Nos. 72-CR-13-6 & 72-CR-12-65 & other Sibley Co. public information.

This is my formal complaint against Sibley Co. Attorney/law enforcement officer David Schauer for Illegally withholding public information. On 05-27-14, 06-11-14 and 06-17-14 I submitted data requests for the above mentioned public information. See attachments. Instead of either sending me my data or sending the data requests to the proper department for processing the data requests, Schauer decided to engage in passive-aggressive behavior designed to waste my valuable time, insult my intelligence and waste valuable government resource in a willful and malicious data dodging scam.

The surprise Navy memo said to negotiate with Mr. MacFarlane over his request and characterize it as a waste of time. It also said, Politico reported, to speak about the cost of fulfilling the request as a means of pressuring Mr. MacFarlane to “narrow the scope” of his FOIA. The memo specifically states: “Again, ‘fishing expedition.’ Just because they are media doesn’t mean the memos shed light on specific government activities.” The U.S. Navy apologized for the memo. Apparently, Schauer doesn't want the world to know how he conspires with the Minnesota State Patrol and the Minnesota Dept of Agriculture to engage in malicious prosecution. Nor does Schauer want the world to know the extent of his misuse of public funds/spending on malicious prosecutions.

Hartmann argued that the evidence seized during the search of his truck on Dec. 4, 2012 and on his farm on Jan. 9, 2013 violated his constitutional rights to be free from an unreasonable search, according to court documents. MacDonald ruled that that initial stop of the truck was constitutional but that (trooper) Heyman did not have reasonable suspicion to do anything more than stop the vehicle and note that it was a farm vehicle. "The problem is Heyman's expansion of the scope and duration of the stop, including three separate, warrant-less and constitutionally unjustified searches of Hartmann's truck. The same reason cowardly Sibley Co. Attorney David Schauer, doesn't call me back, correct? And that reason is the phone call will be recorded, correct? That's correct, isn't it? It is, isn't it?
