SUPPLEMENTAL MOTION TO MODIFY BOND AND CONDITIONS AND TRANSFER RE-TRIAL RELEASE AND ELECTRONIC MONITORING SUPERVISION FROM FLORIDA TO WISCONSIN COMES NOW the Defendant, FIELD MC CONNELL, by and through undersigned counsel and respectfully moves this Honorable Court, for an order modifying certain bond/release conditions previously set and imposed in the above-referenced case and specifically transferring /relocating the Defendant’s pre-trial release and electronic supervision from Stuart, Florida to Plum City, Wisconsin and as grounds therefor would show as follows: 1. The Defendant, FIELD MC Connell is charged in a one count information filed November 26, 2019 with aggravated stalking, a third-degree felony,

In violation of Section 784.048(4), Florida Statutes.
2. This case was previously scheduled for a calendar call on May 7, 2020 but due to the pending Covid-19 pandemic and related court/trial suspensions, it has not yet been rescheduled for any future court proceedings.
3. On April 28, 2020, after extensive communications over a 2-3-week period with the previously-assigned prosecutor, ASA Michael Spear, the Defendant, through counsel, filed an initial motion to modify/release conditions.
4. ASA Spear, after several weeks of conversation(s) with the “alleged” victim, Kim Picazio prior to counsel’s filing of the initial bond modification motion, advised counsel that he had no objections to the requested release condition modifications, set forth in Paragraphs 7 (a)-(c) of the motion, but did object to the Defendant having computer access as detailed and requested in Paragraph 7(d).
5. A Zoom hearing was set was then conducted on April 30, 2020 and this court granted relief requested in Paragraphs 7(b) and (c) with minor modifications and denied the relief requested in Paragraph 7(a) and (d).
6. Unfortunately, it has been discovered by counsel that this Court’s decision was based on false and misleading statements and information provided to this Court on April 30, 2020 by the “alleged” victim, Kim Picazio, both directly and indirectly through ASA Michael Speer.

7. Specifically, despite his previously-stated position, ASA Speer advised counsel and this Court at the Zoom hearing, that based on “new” information he received from Kim Picazio with the past 24 hours, he was now objecting to Field McConnell having unmonitored telephone access with his wife, Denise as sought and detailed in Paragraph 7(a). (April 30, 2020 transcript p. 6)
[Note: April 30, 2020 transcript p. 6 -7. MR. SPEER: Yes, Your Honor. And I would just have to apologize briefly to Mr. Sohn because I am - - after speaking to Ms. Picazio in the last about 24 hours or so I’ve received some new information that I would have to now object to the condition - - the - - the modification to allow Mr. McConnell to have unsupervised phone calls with his wife. Ms. Picazio has informed me that Mr. McConnell’s wife has filed a police report against Ms. Picazio in Wisconsin against Ms. Picazio that had alleged - - brought up some - - personal relationship that Ms. Picazio had had years in the past and dredged up and had basically - - had accused her of lying, that there is a person by the name of Terry Nemors (phonetic) who has more or less represented to Ms, Picazio, as well as associates of hers, that he is representing Mr. McConnell’s wife and has been sending, for a lack of a better Page 6 word, intimidating emails to Ms. Picazio, associates of hers, as well as complete strangers. So, just based on that additional information, there’s some concern about the - - conversation that might be happening with Mr. McConnell’s wife. So, I would apologize to Mr. Sohn. I know I had originally said I didn’t have an objection to that. This new information, unfortunately, changes my position on that. Page 7. 8. This “new” information was that Mr. McConnell’s wife had filed a police reports against Ms. Picazio in Wisconsin that brought up some personal relationship that had had in the past and had accused her [Picazio] of lying. (April 30, 2020 p. 6)
9. These statements falsely represented and gave this Court, the Defendant and undersigned counsel, the distinct impression that this police report was filed shortly prior to the April 30, 2020 Zoom hearing, when it actuality, it was filed ~2 ½ months earlier on February 13, 2020, when the defendant was jailed in Wisconsin.
10. Moreover, the filed police report was not a slanderous attack on Ms. Picazio’s character, but rather, was a complaint, which detailed specific instance where Denise Mc Connell possessed a “good faith” basis to believe, based on the contents of several law enforcement reports, that Ms. Picazio had provided false information to law enforcement. (See attached February 13, 2020 police report) [Note: "The Perjurer" Picazio has a well-documented history of filing false police reports in Florida, Minnesota, and Wisconsin, doesn't she? She does, doesn't she?]
11. Curiously, when Kim Picazio addressed this Court, conveniently not under oath, she did not correct any of ASA Spear’s statements and never produced a [Note: All sorts of Field's less-than-intelligent fantactics blamed Nemmers for Field having monitored and not unmonitored phone conversations with his wife, Denise, didn't they? Let's not forget that it was Field's less-than-intelligent fantactics who sabotaged Nemmers' plans, shall we?]

copy of this police report or told this Court that the Wisconsin police report was filed ~2 ½ months earlier. Ms. Picazio intentionally chose to leave this Court with the distinct impression that the police report was recently filed and was accomplished through allegedly improper communication between the Defendant and his wife, wife while the Defendant was jailed in Florida. [Note: Lies of omission, right?]
12. ASA Spear further advised this court that Ms, Picazio told him that a person by the name of Terry Nemors [Nemmers], told Ms. Picazio and associates of hers, that he is representing Mr/ McConnell’s wife and has been sending intimidating emails to Ms. Picazio, associated of hers and complete strangers (April 30, 2020 transcript 6-7) [Note: Nemmers has never been contacted by law enforcement about any intimidating emails, has he? He hasn't, has he?]
13. As undersigned counsel advised this Court on April 30, 2020, the Defendant and his wife specifically deny any relationship with Terry Nemmers and not surprisingly, Ms. Picazio did not provide this court with any documents to substantiate this claim. [Note: Nemmers would love to see any documentation that Florida celebrity attorney Kim "The Perjurer" Picazio submitted in regard to Nemmers ever contacting Picazio, wouldn't he? Maybe the reason why Florida celebrity attorney Kim "The Perjurer" Picazio's never presented any evidence is because Nemmers never ever contact Picazio?]
14. Finally, ASA Speer, presumably based on information he received from Kim Picazio, represented that videos referring to Ms. Picazio by name are being posted on a regular basis, and that the Defendant’s Facebook and Twitter pages are still up and active, with a Twitter post referencing Ms. Picazio. (April 30, 2020 p 7-8)

15. These representations are in many respects inaccurate, misleading and particularly troubling, since undersigned counsel had extensive conversations with ASA Speer, concerning these very same issues and social media accounts.
16. Specifically, counsel advised ASA Speer prior to the Zoom hearing that the Defendant did not have control of the You Tube channel, and that he attempted through his son, to close the Facebook and Twitter accounts but could not do so because he did not have a recovery email address since he closed his Yahoo email account to comply with the Court’s initial March 6, 2020 bond order. [Note: It was Field's son who bungled this simple project, wasn't it?]
17. Moreover, despite ASA Speer’s representation to this Court that “the Defendant’s Facebook and Twitter pages are still up ad active.” the most recent Facebook post was on January 23, 2012 and the most recent Twitter post was on September 28, 2019.
18. Moreover, in addition to failing and allowing an incorrect, improper and highly inflammatory and prejudicial narrative to be presented to this Court, Ms. Picazio, proceeded to erroneously advise thie Court that the Defendant failed to comply and has repeatedly violated the terms and conditions of his initial bond/release order. (April 30, 2020 transcript p. 9-11)
19. Ms. Picazio’s claims in this regard are blatantly false as the Defendant has fully complied with all of the terms and conditions of this Court’s initial March 6, 2020 bond/release order.

20. Rather that presenting any evidence to establish an alleged release condition violation or correcting the false impression conveyed to this Court, Ms. Picazio, proceeded to verbally attack the Defendant by accusing him of continuing to incite violence against her and characterizing the Defendant as a “Cult leader”, and “that people pray to him” and call him “the anointed one.” (April 30, 2020 transcript p. 9, 11) How the Defendant allegedly continued to incite violence against Ms. Picazio from jail in Florida and from house arrest in his son’s home without telephone, computer or internet access is something Ms. Picazio never explained or even attempted to explain to this Court.
21. Again, and not surprisingly, Ms. Picazio did not provide counsel or this Court with any documentation, evidence or support whatsoever for these spurious, inflammatory and highly prejudicial allegations.
22. Further, and more importantly, since the April 30, 2020 Zoom hearing, there has not been a single bond condition violation committed or alleged by the State to have been committed by FIELD MCCONNELL.
23. Unfortunately, and due entirely to the factually inaccurate statements and materially false representation made to this Court on April 30, 2020 by Ms. Picazio and in some respects, by and through ASA Speer, this Court was not provided with an honest accurate and straightforward basis on which to base its

decision in regard to the previously requested modification of the imposed bond/release conditions.
24. Additionally, and since that time, the Defendant and his family’s circumstances have drastically changed, to the extent a significant modification of the imposed bond/release conditions and the Defendant being allowed to relocate his house arrest/pre-trial service to his home in Wisconsin is appropriate, warranted and mandated.
25. When the Defendant was released from custody on or about March 11, 2020 on the initial bond/release release conditions, no one envisioned a global pandemic, a nationwide shutdown and the virtual closure of courts in this country for ~ nine (9) months and counting.
26. By virtue of this pandemic, the Defendant, a 10-year resident of Wisconsin, who has been residing with his son, daughter-in-law and grandson in Stuart, Florida on “house arrest”, since March 11, 2020, has been physically separated fro his wife by more that 1600 miles.
27. They have not seen each other in more that 13 months, as the Defendant FIELD MC CONNELL was incarcerated in Wisconsin for ~ 3 ½ months before being extradited and transported to Broward County, Florida on February 23, 2020. Their only communications during this entire period of time has been by telephone on a limited and monitored basis. [Note: You need to remember that it was Field's incompetent clown followers who made sure that Field ended up being extradited to Florida, don't you? And you need to remember that it those same incompetent clowns who blamed Nemmers and not Picazio for Denise not being able to have unmonitored phone calls with Field, don't you? And who sabotaged Nemmers' well thought out plan that was working? Did you guess Field and his incredibly stupid fanatics? If you did, then you are correct, aren't you? You are, aren't you?]

28. More importantly, there have been recent developments regarding the health of the Defendant’s family members, which have caused the Defendant and his family to suffer serious emotional and mental stress and trauma, which necessitate the requested pre-trial services and electronic supervision transfer and relocation.
29. In an effort to protect the Defendant’s family’s privacy rights, undersigned would request permission to submit all supporting medical information and documentation by email to this court and prosecutor and would request that this medical inforamtion not be disseminated to anyone outside of the assigned prosecutor, ASA Lily Wong and this Court.
30. Undersigned counsel has contacted and discussed Field’s potential pre-trial services relocation to Wisconsin with House Arrest Services, the company that has been electronically monitoring the Defendant in Stuart Florida since his release from custody on March 11, 2020.
31. House Arrest Services has confirmed that they can electronically monitor Field in the same manner and with the identical monitoring equipment in Wisconsin as they have been monitoring him while in Stuart, Florida. Undersigned counsel previously provided the contact name and telephone number for House Arrest Service to ASA Michael Speer, for confirmation and verification. 32. If allowed to relocate to his home in Wisconsin pending trial, the Defendant, FIELD MC CONNELL would be subject to the same reporting

requirements and release conditions presently in effect. He would be restricted to his home in Wisconsin and only allowed to leave if prior permission for medical, religious and other legitimate and verified purposes is granted by pre-trial services and House Arrest Services.
33. Additionally, all of the telephone, email and internet restrictions, and additional conditions of release, previously imposed and modified by this Court, would also remain in place with full force and effect.
34. Contrary to Ms. Picazio’s prior false and misleading representations to this Court and anticipated misrepresentations in the future, FIELD MC CONNELL has fully complied with all of the imposed and extremely restrictive release conditions for ~9 months.
35. Moreover, Field Mc Connell does not pose any danger to this or any other community, is not a risk of flight and will be fully supervised and electronically monitored at his home in Wisconsin, in the same manner he has been supervised and monitored in Florida.
36. Not surprisingly, when undersigned counsel recently advised ASA Speer of his intention to prepare and file the instant motion and request a pre-trial supervision relocation from Florida to Wisconsin, Ms. Picazio not only objected, but provided additional false and misleading information to ASA Speer to purportedly support her objection.

37. Specifically, Ms. Picazio falsely advised ASA Spear that FIELD MC CONNELL has a broadcast studio and broadcasting equipment in his Wisconsin residence and that is where he previously broadcasted and will continue to broadcast if allowed to relocate to Wisconsin.
38. As undersigned counsel advised ASA Speer and as can be fully documented, FIELD MC CONNELL does not and never did have a broadcast studio and broadcasting equipment in his Wisconsin residence and never broadcasted in any manner whatsoever from his Wisconsin residence.
39. Prior to his Novermber 4, 2019 arrest in Wisconsin for this charge, the Defendant, FIELD MCCONNELL rented a small office in a building located at 401 Main Street, Plum City, Wisconsin. This building was sold while the Defendant was incarcerated in Wisconsin and the Defendant’s wife and family friend, with very little advance notice, were able to remove his personal belongings from this office building before the building’s sale close.
40. Based on the foregoing, the Defendant, FIELD MC CONNELL would submit that a relocation of his Broward County pre-trial supervision and House Arrest Services electronic monitoring from Stuart, Florida to Plum City, Wisconsin during the pendency of the instant proceedings is warranted and appropriate based on the facts and circumstances submitted and discussed above.

WHEREFORE and by reason of the foregoing, the Defendant, FIELD MC CONNELL respectfully requests that this Honorable Court grant the instant motion and enter an appropriate order modifying certain bond/release conditions previously imposed in the above referenced case and specifically transferring/relocating his Broward County pre-trial services supervision and House Arrest Services electronic monitoring from Stuart, Florida to Plum City, Wisconsin during the pendency of the instant proceedings, based upon the reasons, grounds and arguments advanced herein.
