Nicole Names, Pope Co. Human Services Director 320-634-7757 (Office)/320-304-4069 (Mobile):

I am in the possession of a disturbing and harassing email from your office, aren't I? Are you attempting to harass and intimidate a local whistleblower who reported Amanda Peltier's suspicious activity a short time prior to Eric Dean's death? Is it the policy and procedure of Pope Co. Human Services to harass and intimidate whistleblowers? Or is it the policy and procedure of Pope Co. Human Services to harass and intimidate whistleblowers who report well-connected welfare frauds & murderers, hmm? Inquiring minds want to know, don't they?

Why are you having such a difficult time finding an intake summary for the call, huh? Is the intake summary for the reported incident in your computer or isn't it? Or did you hit the "delete button" on the report? The intake summary for that reported incident should have the date, time, intake method, intake type, intake number, source, caller, presenting problem, etc, right? So where is it, huh? Do the Point of Sale (POS) machines and/or Automatic Teller Machine (ATM) at Starbuck's Petro Plus indicate suspicious activity on the Electronic Benefit Transfer (EBT) card or Amanda Peltier or not? How about for any other Pope Co. recipient? Again, inquiring minds want to know, don't they?
Since Pope Co. has a well-documented history of retaliating against whistleblowers, I am requesting the following readily available, free, electronic, public data:

1. 2016 (Or 2015) Pope Co. Human Services policy and procedure manual.
2. 2016 (Or 2015) Pope Co. Data Practice manual.
3. A copy of Intake summary that corresponds to the whistleblower's call. (Whistleblower's name withheld - but is in your possession)
4. Reports of suspicious activity at Starbuck's Petro Plus for the years: 2010 - today's date.

Terry Dean, Nemmers (320) 283-5713

Notice: I will only accept written responses. No harassing emails. Harassing emails will be reported to the proper authorities. (Ex: Badgering the Requester, Misstating the Law, Asked and Answered, etc.)

How does fraud prevention work? Fraud prevention programs prevent and reduce improper payments by resolving eligibility questions for caseworkers. When caseworkers have questions about eligibility or suspect fraud, they refer the matter to investigators. County criminal investigators consider public assistance fraud a crime of theft. Some instances of fraud are considered to  be felony theft and are referred to the criminal justice system. Where fraud has been discovered, the state and counties use a variety of collection methods to recover benefits from recipi ents who have been determined to be ineligible for benefits. http://www.house.leg.state.mn.us/hrd/pubs/ss/sspafraud.pdf Public Assistance Fraud Prevention HOUSE RESEARCH Short Subjects Danyell A. Stahl detailed Eric Dean’s case throughout the rest of the article, using Pope County’s handling of it as an example of the failure of Minnesota’s child protection system as a whole. … According to Stahl’s article, Sen. Torrey Westrom, representing District 12, would like to see that guideline changed. Westrom also called for a change in how social services is directed to share reports of child abuse with law enforcement, citing that only one of 15 reports of suspected abuse was shared with Starbuck Police in Eric Dean’s case. At that same meeting, Pope County Human Services Director Nicole Names and program supervisor Phyllis Reller jointly presented a comprehensive overview of applicable Minnesota state statutes, DHS regulations and procedures required for Minnesota counties to follow. Pope County Human Services, as an arm of the state of Minnesota, follows those procedures in the child protection program as well as other human service programs, Names explained. Q: Why do you personally think the Eric Dean case slipped through the cracks? A: In Eric’s case, an abusive care-giver, uncooperative family members, and investigation after-the-fact made our work extremely difficult and much less clear-cut than some media reports and public officials think with the benefit of hindsight. https://mn.gov/web/prod/static/lawlib/live/archive/supct/2016/OPA141452-021016.pdf  The prosecutor argued in closing: … We conclude that the prosecutor’s remarks mischaracterized the reason for a trial. Implicit in the prosecutor’s remarks is the suggestion that the only reason Peltier exercised her right to a trial was because she hoped some unforeseen circumstance might upset the State’s case, or that the only way Peltier could be found not guilty would be if the State made a mistake. The comments further imply that Peltier only exercised her right to trial in a desperate attempt to “roll the dice,” rather than to robustly confront the State’s allegations with a meritorious defense. These statements were untrue and disparaging, and constituted misconduct. Case No. A14-1452. State of Minnesota, Respondent, vs. Amanda Lea Peltier, Appellant. Pope County.
