Speaking of rubberstamps, why is your so-called transparent model policy on body cameras completely the opposite of Ramsay's personal/public agenda on less transparency for body cameras, huh? A simple comparison/contrast of the two opposites make one scratch their head, doesn't it? It does, doesn't it?


Why is it that you couldn't call me on the phone and repeat your fraudulent bill over the phone, huh? It is because I am very good at making criminals like you and Ramsay look like criminals over the phone? It is, isn't it? And speaking of cowards/criminals who hide behind their voicemails, I have confirmation that the St. Louis Co. Sheriff's dept has received my complaint against Ramsay, haven't I? I have, haven't I? Sunflower Community Action has seen the video of the assault of Anthony Jackson, a wheel chair bound Native American man that was assaulted by Duluth police officer Richard Jouppi. We question why the officer was acquitted of his crimes but are pleased to know that his employment was terminated. We hope that City Manager Robert Layton takes this video and the subsequent actions of the Duluth Police Department in its handling of the situation seriously while he considers the employment of Chief Gordon Ramsay.


My purpose in writing this is not to personally attack anyone, or the NAACP. IACP Body-worn Camera Model Policy. III. PROCEDURES. B. When and How to Use the BWC 1. Officers shall activate the BWC to record all  contacts with citizens in the performance of  official duties. 2. Whenever possible, officers should inform  individuals that they are being recorded. In  locations where individuals have a reasonable  expectation of privacy, such as a residence,  they may decline to be recorded unless the  recording is being made in pursuant to an  arrest or search of the residence or the individuals. IACP LEADS THE WAY ON BODY-WORN CAMERA POLICIES
Citing urgent need for policy guidance, IACP Provides Membership with Body-Worn Camera Model Policy and Technology Policy Framework Resources
Alexandria, VA – In response to the growing interest in and use of body-worn cameras (BWCs) by law enforcement agencies and the urgent need for policies governing their use, the International Association of Chiefs of Police (IACP) has assembled a compendium of policy resources for BWCs. The compendium includes three recently released IACP documents: Body-Worn Camera Model Policy, Body-Worn Camera Concepts and Issues Paper, and the Technology Policy Framework.
In announcing the release of these resources, IACP's President, Chief Yousry "Yost" Zakhary (City of Woodway, Texas), stated, "The IACP recognizes that technology plays a critical and increasingly important role in the daily work of law enforcement officers in the field, equipping them with enforcement and investigative tools that have the potential to make them safer, better informed, and more effective and efficient." President Zakhary continued, "To promote public confidence in, and maximize the benefits of this technology, the IACP believes it is imperative that law enforcement agencies create and enforce comprehensive policies governing the deployment and use of BWCs and other technologies and the data they provide. In order to assist agencies in this effort, the IACP is making the compendium of technology policy resources immediately available to all 23,000 IACP members at no cost."
A growing number of law enforcement agencies are adopting BWCs to document interactions during police-suspect encounters, at crime and incident scenes, and during traffic stops. In many instances, law enforcement agencies have found BWCs useful for officers in the favorable resolution of both administrative and criminal complaints and as a defense resource in cases of civil liability. BWCs provide a clearly documented, firsthand, objective account of what was said and what occurred during the incident in question. In addition, BWCs can provide investigators, prosecutors, and juries with far more detailed, accurate, and compelling evidence. Experience has also shown that BWCs have a positive influence on the behavior of officers themselves, promoting accountability and serving as an important training aid.
The documents contained in the compendium were created in consultation with law enforcement executives and subject matter experts representing IACP Divisions, Committees, Sections, the IACP National Law Enforcement Policy Center, and other organizations and groups. Established in 1987, the IACP's National Law Enforcement Policy Center is a partnership between the IACP and the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. We support the legislative effort and specifically Rep. Cornish’s bill to clarify the data collected by police body-worn cameras. 
We believe any body-worn camera legislation must protect people’s privacy, hold police accountable and ensure body camera programs are manageable for police agencies in Minnesota.
We share Rep. Cornish’s belief that public access to some of the highly personal data that body cameras collect will infringe on basic privacy rights of citizens, have a chilling effect on police-community relations and may serve as a deterrent to crime victim reporting.
We know and fully understand that striking a balance between privacy and public safety is paramount to this debate, and we feel this bill effectively addresses the questions around police accountability, an individual’s right to privacy and a law enforcement agency’s ability to manage a body camera program.
Body-worn camera implementation is complex, raising a number of serious legal, privacy and practical concerns that we must iron out with lawmakers, victims groups and other stakeholders as we move forward.

Dear Ms. Haag:
On September 14, 2015, I received the City of Maplewood’s application seeking temporary classification of certain body camera recording system data (“body cam data”). The City of Maplewood is joined in its application by eighteen other law enforcement agencies across the state, with the application supported
by nine additional Minnesota communities.
As noted in the application, the Commissioner of Administration has only limited authority to issue a temporary classification of data. That authority applies when government data are not otherwise classified as either public or not public in state or federal law. The temporary classification authority does
not allow for data to be reclassified, even when there are legitimate concerns regarding the appropriateness of an existing statutory classification.
Specifically, the application requests that I issue a temporary classification that body cam data which is not active or inactive criminal investigative data, unless data are about an incident involving the use of a dangerous weapon by a peace officer or use of physical force by a peace officer that causes bodily harm,
as defined in Minnesota Statutes, section 609.02, is private data. There are no apparent examples of body cam data that is not active or inactive investigation data. As such, the effect of granting a temporary classification would be to reclassify data that is otherwise classified as public arrest data, response or
incident data, or request for service data in Minn. Stat. 13.82, subd. 2, subd. 3, and subd. 6.
Given the limited temporary classification authority, I cannot accept and must reject the temporary classification request. That decision, however, is not a conclusion that the law adequately addresses the complex and sensitive data circumstances that arise with the use of body cameras.
The application raises many important issues regarding the best practices for balancing the expectation of data subjects that government maintain the privacy of their personal information, with the right of the public to know what government is doing. The application clearly demonstrates both the national and
statewide significance of these issues, ones that can only be fully addressed through the legislative process.
Minnesota’s data practices laws are designed to be neutral to technology. The reality is, however, that body cams have the potential to collect substantial amounts of video and audio in private and very


sensitive circumstances. Body cam data can include much greater detail than might be contained in a written law enforcement report, such as footage of a private home and personal belongings. Greater
statutory clarity regarding how data practices laws should apply to such data would provide essential guidance for all interested stakeholders.
In sum, because the application did not clearly establish that “no statute currently exists which either allows or forbids classification as not public,” the application is not accepted and the request is rejected as provided for under Minnesota Statutes, section 13.06, subd. 3.

As you know, across our nation, law enforcement has been the focus of significant attention and scrutiny. While Minnesota's law enforcement agencies are generally well regarded for their professionalism and service, the call for modernization that offers cutting edge evidence gathering technology with measures to ensure accountability reflects the growing interest in police-worn body cameras. Balancing the critical objectives of government transparency, public interest, and personal privacy is essential for expanded use of this technology. President Obama's 2014 convened Commission on 21" Century Policing explored body worn camera technology and its potential benefits for policing and accountability. It is equally important to note that without needed personal privacy protections, this technology has the potential to undermine the very nature of the relationships law enforcement as a profession is working to develop with the communities they serve.
We know and understand you have limited authority classify data, which is the important role of the legislature. We do however ask that you give critical consideration to our application. We believe the data classification being sought, though limited in scope, provides short term protection to the privacy interests of Minnesotans left exposed by the gap in current law.
Attached you will find an application for temporary classification of police body worn camera data.
While this application is being submitted by the City of Maplewood, you will see that fifteen (15) other Minnesota communities wish to be considered  co-applicants to this request. In addition, nine (9) other governmental entities and the Minnesota Chiefs of Police Association have provided written support for this application.

On behalf of more than 300 Minnesota police chiefs, I am writing to show our collective support for the temporary classification of body-worn camera data until the Minnesota legislature establishes law governing such data.
Unlike police squad car cameras, body-worn cameras collect video footage inside people’s homes, schools and medical facilities, where there is a reasonable privacy expectation. These cameras capture incidents up close often during traumatic, revealing and personal incidents.
Currently, under Minn. Stat. 13.82, much of the sensitive video body-worn cameras collect is public data, and in a day and age where a video clip can go “viral,” protections must be in place.
Without such protections, victims of domestic abuse, criminal sexual assault and other crimes involving sensitive issues may be reluctant to provide statements on camera or cooperate for fear of retaliation. Such reactions could allow perpetrators to continue preying on our communities.
Unprotected data would also provide the general public and suspects “virtual” entry into victims and witnesses’ homes, undermining their safety and privacy.
We can no longer delay implementing body-worn cameras until the legislature resolves these classification issues. According to Minnesota Chiefs of Police Association (MCPA) surveys, at least 40 Minnesota police departments are using body-worn cameras, which are helping gather critical evidence and keep officers accountable.
Furthermore, Minnesota’s police chiefs generally support body-worn cameras as an evidence collection and officer accountability tool, according to an MCPA August internal, non-scientific poll. However, chiefs also share an overwhelming concern about protecting people's privacy, with 60% of responding chiefs rating privacy issues among their main concerns in deploying the devices. Nearly 80% said body-worn camera footage captured in a residence should be classified
in statute as private/non-public.
A recent non-partisan Minnesota Senate poll taken at the state fair reflects law enforcement’s concern, with more than 60% of respondents saying there should be limited public access to police body-camera footage and 14% saying the footage should be strictly private
 


MCPA feels the temporary classification application currently before the Department of Administration strikes the proper balance among three key pillars: protecting people’s privacy, gathering evidence to solve and prosecute crimes, and promoting accountability and transparency in the profession.
