This report will detail follow-up on a suspicious comment on Twitter involving court staff.
NARRATIVE
On March 6, 2017 I, Detective Qualy, was assigned follow-up on a suspicious activity incident. I was advised that Judge Karen Asphaug and Dakota County Attorney Kathy Keena observed a suspicious tweet on a twitter account maintained by the Twitter handle Jane Johnson (@johnsonmedia2). The tweet was posted on March 2,
2017 and included the comment " I "Believe" MN Law Clerk to Judge Karen Asphaug, Megan Loyas will be Owen a lot to Judge Asphaug for her role...#grazzinirucki" The concern on the tweet was Megan Loyas is Judge Asphaug's law clerk and was directly involved in several of the court hearings that involved Sandra Sue Grazzini-rucki, date of birth 09-30-1965. The tweet also included "Owen" which is the name Mrs. Loyas son. During past court hearings involving Mrs. Grazzini-rucki there were issues of her and several of her supporters posting comments and photographs on twitter, Facebook and other social media accounts. At times some of the comments appeared to be possibly threatening or harassment in nature. I attempted to contact Megan Elizabeth Loyas, date of birth 01-23-1985 who is still currently a law clerk
for Judge Asphaug. I was provided an email exchange about the tweet, and I was able to personally view it on March 6, 2017.
I was able to contact Mrs. Loyas on March 9, 2016. In a recorded phone call I asked Mrs. Loyas if she was aware of the comment on Twitter. Mrs. Loyas stated she was aware, we spoke about the comment, she explained that she didn't feel it was an out right threat of harm to herself or her family but was concerned about its tone and that it had a play on the word "owe" by using her son's name. incidents that involved social media issues with Mrs. Grazzini-rucki and didn't feel I needed to follow-up any further on this incident. Her hope was that the issue would just go away over time. I explained to Mrs. Loyas that we could request account information from twitter and actively investigate the incident and she declined the offer and again explained that nothing needed to currently be done. I explained to Mrs. Loyas that if she felt it needed to be investigated further to contact me or our investigations division. Mrs. Loyas is fully-aware of the court process to obtain a harassment and restraining order.
On March 9, 2017 I was notified by Sergeant Matt Wayne that he was also looking in to a social media post that involved other court staff from past court cases involving Mrs. Grazzini-rucki. Sergeant Wayne advised he was going complete his reports under this same case-file. Sergeant Wayne advised he was going to subpoena twitter for the account holder information for the account Jane Johnson (@johnsonmedia2).

This report details the investigation of defamatory social media posts which mention Dakota County Judge David Knutson.
NARRATIVE
On February 13, 2018, I, Detective Brian Eells, assisted Sergeant Matt Wayne with his investigation into posts made on the social media website "Twitter" which involved a Dakota County Judge.
Sergeant Wayne told me that Judge David Knutson became concerned when he learned of Twitter website posts from a user which appeared to threaten and defame his character. The comments were written by an individual using the Twitter user account "@johnsonmedia2" and had the vanity name "Jane Johnson". For evidence purposes I used the web application Fireshot which preserved the Twitter profile as it appeared at that time and date. I reviewed the two "Tweets" that had caused Judge Knutson safety and reputation concerns:

On the same date I sent Twitter a preservation request for the "@johnsonmedia2" account. I received a confirmation the account was preserved and assigned to Twitter case number 77166590.
On March 8, 2018 I continued investigation into the identity of user "@johnsonmedia2". Sergeant Matt Wayne previously investigated this user for similar circumstances detailed in DCSO case 17900122. During that

investigation he obtained account records from Twitter which could further assist to identify the suspect. I asked DCSO Analyst Bernt Bratager to review IP address information which had hundreds of phone numbers assigned
as users during the period of the social media posts. To avoid disclosure to the suspect in this case I used the documents already obtained from the previous investigation to assist with learning the identity or location of "@johnsonmedia2". I provided Analyst Bratager six separate social media posts and IP address information to use for comparison. Analyst Bratager told me he found a disclaimer page on the user's account which detailed how the blog was intended to be entertainment and that the information may not be accurate.
On March 12, 2018 I received an e-mail from Analyst Bratager with his analysis of the IP address data. He was able to determine that cell phone number, 206-258-1908 had been a common number assigned to the IP addresses involved in five of the six posts. Using law enforcement databases I was able to determine that phone number's provider was Verizon Wireless and likely being "ported" from another number for the suspect to remain anonymous.
On April 9, 2018 I sent an administrative subpoena signed by the Dakota County Attorney to Twitter asking for basic subscriber information related to account "@johnsonmedia2".
Twitter had created a law enforcement portal which would allow us to flag illegal content for review and possible removal from the web site. Judge Knutson said his primary concern was for the defamatory content to be removed as the general public may believe the information was true and would damage his public reputation. I explained the complex measures the suspect was taking to remain anonymous. I explained to Judge Knutson that we would attempt to locate the account user and if that failed would request Twitter remove the posts due to their illegal defamatory content. Judge Knutson agreed with that course of action and appreciated our continued efforts with this investigation.
On April 12, 2018 I received a notice from Twitter's legal team which explained they would not provide IP address information as Minnesota administrative subpoena's did not comply with California criminal proceedings (Cal. Penal Code § 1334) . They also would not recognize the Minnesota statute related to non-disclosure and would alert the user to any legal requests from law enforcement. Twitter legal team advised that with a search warrant and Federal non-disclosure order (18 U.S.C. § 2705(b)) they would provide IP address information and not alert the user of the legal process request. At this time Sergeant Wayne and I determined the most reasonable course of action based upon the nature of this case would be to create an informal request to Twitter for the defamatory posts to be removed.
n April 23, 2018 I sent a request to Twitter to have both aforementioned posts removed from the website and the user "@johnsonmedia" to be notified such content was illegal and in violation of their terms of service. In my

request I cited violation of Minnesota state statute 609.765 as the legal reason for my request. Twitter responded with a confirmation that request was received and that it would be reviewed by their legal team.

NARRATIVE
On May 1, 2018, I, Detective Brian Eells, received an e-mail from Twitter related to this investigation.
As detailed in my previous supplemental report I utilized Twitter's law enforcement portal to flag content from the account "@johnsonmedia2". The content was threatening and defamatory in nature toward a Dakota County
Judge David Knutson. Twitter responded to my request writing that they were refusing to remove the content as it did not violate their terms of service. Their e-mail response is included in this case file.
At this time in the investigation various steps have been taken to identify the user "@johnsonmedia2" which have included administrative subpoena's to both Verizon and Twitter. I have not been able to ascertain the identity of the user based upon the records I have received. The threatening post about Judge Knutson did not meet the criteria for Terroristic Threats (MN statute 609.713). The defamatory post did meet the criteria for Criminal Defamation (MN statute 609.765) however the user of "@johnsonmedia2" has taken several advanced steps to hide their identity and location. As before in related DCSO case 17900122 both Sergeant Wayne and I have been unable to identify the user of Twitter account "@johnsonmedia2". In that investigation Sergeant Wayne wrote a search warrant to Twitter requesting records related to "@johnsonmedia2" and was unsuccessful in learning the identity of the user. I have also reviewed those records in an attempt to identify the user and have been unsuccessful.

On May 17, 2018 I met with Judge Knutson to speak with him about this investigation. I provided him information about Twitter's public portal which allows a private citizen to request content be removed if they feel it is
defamatory or threatening in nature. I suggested that if he made a request as a private citizen it may hold more weight with Twitter as requests from law enforcement have been unsuccessful.
This investigation will be closed as inactive.

On 3/6/2017 your affiant received a case from the Lakeville Polce Department regarding Twitter posts from the profile name @jojhnsonmedia2. The posts defame Edward Charles Straight 12/21/1946 and David Victor Rucki 02/03/1963.
I spoke to Mr. Straight and he stated he saw these tweets and were upset about them. I asked Mr. Straight if any of the things stated were true and he said they were not. Mr. Straight believes the tweets are from Sandra Sue Grazzini-Gucki 09/30/1965. He state he believes she posted these tweets because he attended a recent trial she was a defendant in.
The two tweets on 03/15/2017 regarding Mr. Straight said the following, “Will Lakeville Mn finally stop crime against our children starting with “Ed” Straight of Mn ...sick #grazzinirucki@DakotaCountyMn” and “#grazzinirucki Allegdly “Eddie” Straight Lakeville MN has been named in numerous scams & crimes involving children”.
I spoke to Mr. Rucki and he stated he viewed the Twitter page in question and stated the following tweets about him were not true. The Tweets were from Jane Johnson @johnsonmedia2.
2/27/2017 “Noting is sicker than men who abuse there wife & children repeatedly & then claim their the victims #permanentsolutionforsociopaths” and picture of Mr. Rucki and what appears to be a Minnesota District Judge.
