Q. Drawing your attention to April 19 th , 2013 were you employed in your current position?
A. Not my current position, I was in Patrol.
Q. So you were a patrol officer.
A. Correct.
Q. And on that date, did you respond to a residence in the City of Lake – or Lakeville regarding a report of two runaway girls?
A. I did.
Q. And was that report made through a 911 call?
A. Yes, it was.
Q. And do you know who made the 911 call?
A. Yes, it was.
Q. And do you who made that 911 call?
A. Tammy Love.
Q. And do you recall what time that call was received?
A. I believe it was approximately 7:45 p.m.

Q. And at that time then did Tammy Love provide you with any information as to how the mother could be contacted?
A. You know, I don’t recall if she provided me the information. I mean I spent some time there going over the history and some other things I needed for my runaway report. But at some point, I did obtain an address that we believed Sandra was staying at in Elko as well as a cell phone number. It’s possible, thogh, I may have gotten that from my squad computer and in- house records check. I just don’t remember where I got the information.

Q. Were you able to determine the type of vehicle Ms. Grazzini-Rucki was driving?
A. Yes. And again, I don’t recall if I learned it through a DVS website through the state or whether or I found it in our in-house records or if Tammy helped identify it, but it was a white Cadillac Escalade. I was able to obtain the information, including the license plate, and then with that information, I was able to put out an Attempt to Locate on the vehicle.
Q. And what does an Attempt to Locate mean?
A. It’s basically a law enforcement message that we distribute primarily to mobile computers or squad computers directly to the officers out on the street to help identify either an individual – or correction – to help locate either an individual or vehicle.
Q. And do you recall how wide-spread your Attempt to Locate was issued?
A. I issued that for metro-wide, and it was good for 72 hours.
Q. And when you say “metro-wide,” how –
A. Seven-county metro area.
Q. Did you have any success in locating the defendant’s vehicle using the Attempt to Locate?
A. No, I did not.

Officers conducting all criminal investigations will, whenever possible, record oral victim and witness statements in lieu of written statements. Statement evidence obtained during an initial investigation can be very powerful evidence in determining the course of an investigation; ultimately impacting charging decisions and convictions. It is not necessary to advise a victim or witness that their statement is being recorded. Officers should use discretion when determining the best method of recording depending on the circumstances of the event. A. . Yes, it was predetermined. It's a two-year rotating position. You leave patrol, do two years detective work, then go back to patrol.
Q. And so you then were in patrol for 17 years?
A. Correct.

Q. Did you determine or were you able to determine what type of vehicle Ms. Grazzini-Rucki was driving as of April 19th, 2013?
A. I did, and that would be a white Cadillac Escalade.
Q. And how did you determine that information?
A. Again, I -- it may have been provided to me by Tammy, or more likely, it was probably something I found in our in-house records check.
Q. What did you do upon learning that information?
A. I contacted our dispatchers and asked them to disseminate a Attempt to Locate, a cops' alert, on that vehicle and check the welfare of the girls.
Q. And what does an Attempt to Locate mean?
A. It's a tool law enforcement uses to disseminate a message to the mobile computers in police squad cars to try to help locate either an individual or a vehicle. It's a tool where we can ask other agencies' assistance in finding somebody.
Q. And do you know how widespread this Attempt to Locate went?
A. You can determine how far that goes depending on the circumstances.
Q. I believe in this one, it was metro-wide. And we've all heard of AMBER Alerts. Are you familiar with AMBER Alerts?
A. Yes, I am.
Q. And why was an AMBER Alert not issued in this situation?
A. Based on the information at the scene, based on the information provided to me by Ms. Love, there was no indication at this point that the girls did not leave on their own free will or that there was any type of foul play involved.
Q. When you issued the Attempt to Locate, did you have any success in locating Ms. Grazzini-Rucki?
A. No, we did not.
