In May of 2012, Ryan Stanek was busted for marijuana possession in Maple Grove – a misdemeanor for which he paid a small fine. Property Cases
Pre-Charge Diversion Eligibility 1) Loss is felony level but $2,000 or less
Post-Charge Diversion Eligibility 1) Loss must be $5,000 or less
Exclusions The decision whether or not to divert a case is the prosecutor’s. In determining whether to offer diversion, the prosecutor may consider other issues including, but not limited to: extreme addictions issues
Conditions of Diversion ... Violation of any of the conditions can result in a client being terminated from the program ... No further criminal involvement; 16 ... 16 This refers to no new felony arrests and no new criminal charges at any level. See “Unsuccessful Termination,” (pg. 11). ...The screener may request a chemical health evaluation; a more formalized Rule 25 chemical health assessment or private insurance assessment; or that the client enter into a Chemical Dependency Contract with the chemical dependency counselor. ... The goals are incorporated into a goal contract that is signed by the client. While the counselor encourages and works with clients to achieve their goals, adherence to the contract is not one of the conditions of the program, and failure to meet one of the goals is not a reason for termination. The exception is when the client has signed a chemical health or mental health contract. Then, the terms of these “specialized” contracts become conditions of diversion, and non-compliance can result in termination. Minnesota Statute 401.065 401.065 PRETRIAL DIVERSION PROGRAMS. Subd. 3a.Reporting of data to Bureau of Criminal Apprehension. (a) Every county attorney who establishes a diversion program under this section shall report the following information to the Bureau of Criminal Apprehension: (5) the date on which the individual was removed from the diversion program for failure to successfully complete the individual's goals, where applicable.
