Why would you even consider the common criminal Tracy M. Smith, Deputy General Counsel for the University of Minnesota/At-Large Member, Commission on Judicial Selection for a Court of Appeals candidate? Inquiring minds want to know, don't they? Attorney Smith is nothing but a common criminal, isn't she? See attached evidence. Smith has a long and sordid history of harassment and illegally withholding readily available free electronic public data from me. In fact, the only way that I received some electronic data from Smith was to inform William P. Donohue, Office of the General Counsel (612) 624-7569 that I considered him the mastermind behind the harassment and the violation of the Minnesota Data Practice Act. I also informed Donahue that I was probably going to file criminal charges against him like I did UMM Chancellor Jacqueline R. Johnson 320-589-6020. Would you like the audio recorded message emailed to you?

Smith has been illegally withholding readily available free electronic public data to cover up (2) two UMM scandals: UMM Paul "Appeals to Ridicule" Myers' vandalism of a school sanctioned newspaper and a scandal involving the botched raid by the UMM's West Central SWAT team.

I am also sure that you are aware of the UMM student newspaper scandal that has haunted Prof Paul "Appeals to Ridicule" Myers. What you may not be aware of is that the UMM is currently illegally withholding the handwriting sample provided by Prof Myers and the audio statements in the abbreviated and slipshod investigation. Prof Myers’ police report was only released after I filed a criminal complaint against UMM Chancellor Jacqueline R. Johnson and Prof Paul Myers.

Prof Paul  "Appeals to Ridicule" Myers isn’t doing any of the things that you would expect an innocent individual to do, is he? No, he isn’t. If Prof Myers was innocent, then he would be demanding that the handwriting sample be sent to the BCA lab to prove that he was innocent, wouldn’t he? He would, wouldn’t he? If Prof Myers was innocent, then he would be demanding that the handwriting sample be released to the public so they could send it to a private lab to prove that he was innocent, wouldn’t he? He would, wouldn’t he? If Prof Myers was innocent, then he would be demanding that the University of Minnesota, Morris stop illegally withholding the apparently incriminating handwriting sample and audio statements, wouldn’t he? He would, wouldn’t he? Instead Prof Myers and common criminal Tracy M. Smith, Deputy General Counsel for the University of Minnesota appear to be in damage control mode.

Smith second scandal is the cover up of the malicious raid of America’s Best Value Inn in Glenwood by UMM's West Central SWAT team. The UMM's West Central SWAT team misused local, municipal, county, state and federal resources on a wild goose chase at the America’s Best Value Inn in Glenwood for fugitve Andrew Dikken. My source indicated that the UMM's SWAT reconnaissance knew Dikken was no where near the inn property prior to the raid. Yet, despite that fact the inn was raided. My source indicated in their audio statement that the inn lost money because of the publicity stunt. To cover this up Smith is making wild and outrageous claims that the UMM"s member were not present at the inn. Yet, Smith willfully refuses to produce the readily available free electronic public data that is in her possession to substantiate her utter nonsense.

It's not surprising that both UMM's Prof Paul  "Appeals to Ridicule" Myers and Yellow Medicine Co. Sheriff Bill "Threat to your safety" Flaten have been forced to change their loony stories with my coverage of their scandals, is it? See below.

Smith's malicious tactics are to misrepresent the digital audio files as audio tapes; (Note: a member of the West Central SWAT team has already emailed me audio files in DSS format, haven't they?) sent a fraudulent bill for large sum of money for readily available free electronic public data; partially fulfilled data requests; making wild and outrageous claims that her UMM SWAT team member was not present at the malicious SWAT raid; harassing emails that drip with passive-aggressive behavior; and thinking and acting like she is above the law. Sounds like Smith is the perfect candidate for Minnesota's lawless courts, doesn't it?

I just got back from the campus police, where I was read my Miranda rights and recorded giving a statement, because the Geiger cranks have apparently made a formal complaint, accusing me of stealing their rags and adding a new charge, that I’d vandalized the latest edition, scribbling an “str” on the cover to change “right-to-life” to “right-to-strife”. A 911 call to the Yellow Medicine County Sheriff’s Office resulted in the search of the America’s Best Value Inn, a hotel located on state Highway 28 in Glenwood. The tip, deemed credible by law enforcement, described a man matching Dikken’s description. ...“Once it was deemed a credible report, we took it seriously and followed up on it,” Danter told the Pope County Tribune Thursday afternoon. … After the hotel search, it was determined that the tip was unfounded, and Dikken was never at the hotel or even in Glenwood, Danter said Friday morning. UMM student newspaper scandal that has haunted Prof Myers: What? There was no scandal, and I haven’t been haunted by anything.  It’s a little peculiar that I’m accused of acting above the law because in an incident in which someone defaced some cheap racist newspapers by scribbling on them, I obliged the law by giving a handwriting sample, which didn’t match (and probably couldn’t match — it’s a pretty short scribble) Prof PZ Myers aka "Mr. Logical Fallacy" November 15, 2015.

Dean Johnson has been a parish pastor at Calvary Lutheran Church in Willmar, Minnesota for 42 years. He also was elected to the Minnesota House of Representatives (1978 to 1982) and the Minnesota Senate (1982 to 2006), where he served as minority and majority leader. A brigadier general in the United States Army National Guard, he was special assistant to the chief of chaplains, National Guard Bureau, Washington, D.C., and received numerous awards and commendations, including the Legion of Merit. Johnson grew up on a farm near Lanesboro, Minnesota. Linda Cohen is a psychologist and marriage and family therapist. Previously, she was a consultant for TCF Bank, directing a business-education partnership with Patrick Henry High School in Minneapolis, assistant director/interim director of Blake Middle School, and a senior administrative team member of the Blake School. Since 2000, Cohen is a member of the Board of Education of Wayzata School District. She currently serves as Chair. Patricia Simmons is a retired physician, executive, and professor who was the founding chair of the Division of Pediatric and Adolescent Gynecology at the Mayo Clinic. At Mayo she has served on the Executive Committee of the Board of Trustees and the Board of Governors, as Chair of the Executive Board of Mayo Medical Ventures, and as Executive Medical Director for Health Policy.  She has been a national leader in her medical field, including president of her national professional society.  Simmons, who received a bachelor's degree from Carleton College, magna cum laude, and a medical doctorate from the University of Chicago, completed her residency and fellowship at the Mayo Graduate School of Medicine. She has been actively involved in her local community, Minnesota's business community and cultural organizations, a frequent author and lecturer in her fields, and recipient of awards for excellence in teaching. Prior to coming to OGC, she served as law clerk to Judge Max Rosenn, United States Court of Appeals for the Third Circuit. Tracy was also an Assistant Attorney General for the State of Minnesota. ST. PAUL, MN – At a news conference this morning, Governor Mark Dayton announced that he will appoint Lee Sheehy to continue as Chair of the Minnesota Commission on Judicial Selection. Mr. Sheehy has held the post since his appointment by the Governor in 2011. Governor Dayton Appoints Commissioner Lucinda E. Jesson and Tracy M. Smith to Minnesota Court of Appeals
Appointments fill vacancies created by the appointment of the Honorable Natalie E. Hudson to the Minnesota Supreme Court, and the retirement of the Honorable John P. Smith

ST. PAUL, MN – Governor Mark Dayton today announced his appointments of Lucinda E. Jesson and Tracy M. Smith to serve on the Minnesota Court of Appeals. Commissioner Jesson and Ms. Smith will fill two at-large vacancies, replacing the Honorable Natalie E. Hudson, who was appointed earlier this year to the Minnesota Supreme Court; and the Honorable John P. Smith, upon his retirement from the Court of Appeals, which is effective February 2, 2016.

About Lucinda E. Jesson
Lucinda E. Jesson has served as Commissioner of the Minnesota Department of Human Services since her appointment by Governor Dayton in 2011. In that role, Commissioner Jesson managed a $36 billion budget, 6,200 state employees, and state programs serving more than 1 million Minnesotans. During her time as commissioner, she championed cost-saving reforms and better-quality services for Minnesotans.

“Lucinda Jesson has done a superb job managing Minnesota’s largest state agency,” said Governor Dayton. “I am deeply grateful to Ms. Jesson for her outstanding service to the people of Minnesota, and have the utmost confidence in her judgment. Her impeccable qualifications for this position speak for themselves. I am certain she will bring the same measure of excellence to the Minnesota Court of Appeals as she has demonstrated during her service at the Department of Human Services.”

Prior to her appointment as commissioner, Ms. Jesson was an Associate Professor of Law at Hamline University, and a partner at Oppenheimer, Wolff & Donnelly, LLP. Ms. Jesson also previously served as Chief Deputy County Attorney for the Hennepin County Attorney’s Office, and the Deputy Attorney General in the Minnesota Attorney General’s Office.

“Public service has been the cornerstone of my career, from my work as chief deputy in the Hennepin County Attorney’s Office to being commissioner of the Minnesota Department of Human Services,” said Commissioner Jesson. “I am grateful for this new opportunity to serve the people of Minnesota.”

Commissioner Jesson serves on the executive committee of the Olmstead Subcabinet and is the Co-Chair of the Children’s Justice Initiative, the Minnesota Interagency Council on Homelessness, Task Force on Health Care Financing, and the Governor’s Task Force on Child Protection. She earned her Bachelor of Arts degree from the University of Arkansas and her Juris Doctor degree from the University of Pennsylvania Law School.

About Tracy M. Smith

Tracy M. Smith currently serves as Deputy General Counsel for the University of Minnesota, where she is responsible for representing the University in general litigation in state and federal district and appellate courts. In this role, Ms. Smith has provided legal services for the University, managing a wide range of legal issues, including employment law, constitutional law, antitrust and business tort claims, and more.

“Throughout her career, Tracy Smith has managed an impressive variety of complex legal issues,” said Governor Dayton. “From representing Minnesota’s largest university, to representing the State of Minnesota and its agencies in the Office of the Attorney General, Ms. Smith’s professional legal experiences have prepared her for success on the Minnesota Court of Appeals. I am confident she will be an exceptional judge.”

Previously, Ms. Smith served as Associate General Counsel for the University of Minnesota. She also served as Assistant Attorney General in the Minnesota Attorney General’s Office, where she represented the State of Minnesota in consumer fraud investigations and lawsuits, worked on civil antitrust investigations, and handled a number of criminal appeals. Ms. Smith also served as judicial law clerk for the United States Court of Appeals for the Third Circuit.

"Service on the court of appeals is a great privilege,” said Tracy M. Smith. “I am honored to have the opportunity and mindful of the solemn obligation all judges have to the people they serve."

Ms. Smith is actively engaged with the Minneapolis Public Schools, volunteering at Southwest High School and having served on the Minneapolis Public Schools Advisory Committee on Global Languages and the Minneapolis Kids Advisory Board. She has also volunteered as a teacher for English language learners at Neighborhood House in Saint Paul. Commission on Judicial Selection Recommends Court of Appeals Candidates to Governor Dayton

ST. PAUL, MN – The Commission on Judicial Selection announced today it is recommending four candidates to Governor Mark Dayton for consideration to fill two at-large vacancies on the Minnesota Court of Appeals. These vacancies were created upon the appointment of the Honorable Natalie E. Hudson to the Minnesota Supreme Court and the upcoming retirement of the Honorable John P. Smith, effective February 2, 2016.

Judge Diane B. Bratvold: Judge Bratvold serves as a District Court Judge in the Fourth Judicial District. Prior to her appointment, she was a shareholder at Briggs and Morgan P.A., partner and associate at Rider Bennett, LLP, and an attorney at Fetterly & Gordon, P.A. Judge Bratvold serves as the Director and Treasurer of Advocates for Human Rights, is a board member for the Zion Lutheran Foundation in Anoka, volunteers as a mentor at the University of St. Thomas Law School, and previously served as Director and Secretary of the Champlin Park Vocal Music Association.

Judge Jeffrey M. Bryan: Judge Bryan serves as a District Court Judge in the Second Judicial District. Prior to his appointment, he was an Assistant United States Attorney in the United States Attorney’s Office and a civil litigation attorney at Robins, Kaplan, LLP. Judge Bryan serves as an executive board member on the Minnesota Urban Debate League and is involved with various committees with the Minnesota Hispanic Bar Association. Commission on Judicial Selection Recommends First Judicial District Candidates to Governor Dayton

ST. PAUL, MN – The Commission on Judicial Selection announced today it is recommending three candidates to Governor Mark Dayton for consideration to fill the current vacancy in Minnesota’s First Judicial District. This vacancy was created upon the retirement of the Honorable Mary J. Theisen, and will be chambered at Hastings in Dakota County.

Phillip Prokopowicz: Mr. Prokopowicz serves as the Chief Deputy Dakota County Attorney, where he is responsible for handling misdemeanor, gross misdemeanor, felony, and juvenile delinquency cases. Previously, Mr. Prokopowicz was the head of the Dakota County Criminal Division, the Assistant Dakota County Attorney, and an adjunct professor at William Mitchell College of Law. Mr. Prokopowicz has volunteered for the Inver Grove Heights Parks Department as a youth baseball and soccer coach and formerly served on the Board of Directors for the Inver Grove Heights Community Schools.

Gary Voegele: Mr. Voegele is an attorney at Gary L. Voegele, P.A., where his practice includes family law, personal injury, real estate, probate, business law, and civil and criminal matters. He also works as an adjunct professor at the University of St. Thomas’ Opus College of Business. Previously, Mr. Voegele was a Child Support Magistrate and contract Administrative Law Judge at the Office of Administrative Hearings. Mr. Voegele has served as a board member of the Minnesota State Bar Foundation and the Faribault Foundation, and is the former Chair of the Family Law Section of the Minnesota State Bar Association.

Richelle Wahi: Ms. Wahi is a partner at Lindquist & Vennum LLP, where she handles cases primarily in family law and general litigation. She also serves as a Conciliation Court Referee in Dakota County and previously was an attorney at Moss & Barnett. Ms. Wahi volunteers with the Tubman Safety Project, coaches volleyball for the Eagan Athletic Association and softball for the Mendota Heights Athletic Association, and mentors law students from the University of St. Thomas Law School, Twin Cities Diversity in Practice, and William Mitchell College of Law.

Minnesota’s First Judicial District consists of Carver, Dakota, Goodhue, LeSueur, McLeod, Scott and Sibley Counties.
