Hello Mr. Nemmers,

Thank you for contacting us in regards to the request for records you made. We appreciate your feedback and we're sorry that you do not agree with our estimate. All requests are treated the same and all request with a time frame exceeding 15 minutes or more receive an estimate for the cost involved with research and redactions. If the request is handled and processed in less than 15 minutes; we provide that at no cost to our customers. Since the request you made for audio statements totals approximately 60 minutes; you were sent a quotation for a time range completion of 1-3 hours and an estimate of $30.00 - $90.00. This is in conjunction with F.S.S. 119 as we earlier indicated in our quotation to you.

A "special service charge, " as provided in s. 119.07(4)(d), Florida Statutes, will apply to this request at the rate of $30.00/hour for the actual time required to complete the request.

We provide cost estimates based on a low and then a high figure using a 2-3X multiplier. Most request stay within the low figure but we like to quote a higher number as well in the event there is more redactions needed. With regard to your statement regarding the transcriptions - unfortunately statements at times could be taken outside or where a police radio is broadcasting. Certain criteria that isn't transcribed (such as radio traffic) that provides Criminal History Data (Criminal History Data (FCIC/NCIC) - §943.0525; FAC 11C-6.004) would then have to be redacted. Additionally; a 911 caller may be the person giving the sworn statement in which per statute would be redacted (ID of caller to "911" - §365.171(12)).

The matters mentioned above could come at any point of the audio so therefore we must review the full complete audio to determine if any statutory exemptions apply to this request.

We are more than happy to fulfill your request as any of our other customers. As originally indicated; there are approximately 60 minutes of recorded audio statements relating to this case. The estimate will be 1 - 3 hours of labor to listen to the audio (again most likely will stay around the 1 hour range but if we have to redact, it may be between those time frames) and your cost will be between $30.00 - 90.00 (again most times the cost stay around the low end but could have the potential to go higher based on how many redactions).

We have spoken to our supervisors regarding your concerns and our superiors advised your request will be treated as any other request is treated which is what we are doing here now in accordance with F.S.S 119. There will be no further discussion on this matter with the exception of you accepting or declining this estimate. Failure to provide a written response within the noted 10 days will cause this request to close out automatically.

Digital Evidence Unit In January 2016, the Broward Sheriff's Office created the Digital Evidence Unit. This new unit is responsible for the development, deployment, and support of the BSO body-worn camera system; management of the digital evidence database; case filing of digital evidence with state prosecutors; creation and dissemination of approved and redacted digital evidence for public records requests and media release. The body-worn camera program is underway with full deployment expected by the end of 2017. There will be approximately 1200 body cameras in our neighborhoods protecting our citizens and deputies. Officers conducting all criminal investigations will, whenever possible, record oral victim and witness statements in lieu of written statements. Statement evidence obtained during an initial investigation can be very powerful evidence in determining the course of an investigation; ultimately impacting charging decisions and convictions. The link took me to Sarah Westall's website where Kim stated that there were two recording between her and Jerimiah Regan. Kim admitted that she had a sexual affair with Regan when she was married. Kim stated that she did not know when or how the conversation was recorded but neither Jerimiah or Kim consented to the recording being done or being disclosed. Kim cited MN State Statute 626A.02 which states that disclosure of an electronic communication is a crime. She stated that she only wanted the recordings taken off her website. On Monday, March 9th, 2020 I made contact with Management at the River Valley Inn and Suites to see if there were any more incidents regarding this case. Hotel Management advised me that Sheridan had checked out of the hotel on or around February 18, 2020. That is the day after Officer Lehman and I spoke with Sheridan at the hotel last. This investigation will be closed, pending any additional information. Reports that Sheridan was being held against her will were unfounded and, according to Sheridan, completely false. This case generated a significant amount of interest and information from parties not directly involved and 3rd party information posted on websites. During our investigation, we were able to confirm Sheridan was not being held against her will.
