I have reason to suspect that the MN School Boards Association Executive Director Kirk Schneidawind, ISD #2853 Interim Superintendent Larry Peterson, ISD #2853 Chairman Scott Conn, and ISD #2853’s legal counsel Rupp, Anderson, Squires & Waldspurger are conspiring to violate the Minnesota Government Data Practices (MGDPA) act by illegally withholding/delaying readily available, free, electronic public data to cover-up a rigged superintendent search. By “rigged” I mean misusing public resources to vet and to hire an unqualified candidate who has a well-documented history of willfully violating the MGDPA.
The unqualified candidate that I am referring to is ISD #2149 Minnewaska Area Schools Superintendent Gregory Schmidt. Schmidt is currently illegally withholding readily available, free, electronic public data for ISD #2149‘s high-profile Facebook lawsuit Case 0:12-cv-00588-MJD-LIB. (Note: A lawsuit that ISD #2149 quietly settled after loudly boasting and bragging of innocence, right?) See attached 08-03-14 Chapter 13 data request. How is it possible that a legitimate search firm could (1) miss my damning information about Schmidt on their candidate social media search? and (2) vet a candidate when the search firm teaches that willful MGDPA violations are just cause for job termination?
VII. PENALTIES FOR VIOLATION OF DATA PRIVACY A. The school district is liable for damages, costs and attorneys’ fees, and in the event of a willful violation, punitive damages for violation of state data privacy laws. (Minn. Stat. § 13.08, Subd. 1) B. A person who willfully violates data privacy is guilty of a misdemeanor. (Minn. Stat. § 13.09) C. In the case of an employee, willful violation constitutes just cause for suspension without pay or dismissal. (Minn. Stat. § 13.09). The School Board has established the following timeline for conducting its search for a new
superintendent.
The deadline for receiving applications is February 13, 2017
The screening meeting will be held on February 21, 2017
The first round of interviews will begin February 24, 2017
The second round of interviews will be held March 2, 2017
The new superintendent’s contract will be approved on March 27, 2017
All board meetings related to the superintendent search, including the first and second rounds of interviews, are open to the public to listen to the proceedings
Instead of immediately emailing me this readily available, free, electronic, public data I was harassed with with ISD 2853 passive-aggressive, time and resource wasting tactic. The malicious delaying tactic was to make the wild and outrageous demand that provide my Name, Address, Phone number, e-mail
address, Signature of Requesting Party before they would email me my requested data.
Any administratively and technically qualified Responsible Authority would know or should know that the MGDPA specifically states that I cannot be required to identify myself.
13.05 Duties Of Responsible Authority. Subd. 12. Identification or justification. Unless specifically authorized by statute, government entities may not require persons to identify themselves, state a reason for, or justify a request to gain access to public government data. Part 2: Set Parameters for Data Requests The Data Practices Act does not require that individuals make data requests in writing; however, IPAD recommends that government entities make this their policy. If you decide to require written requests, you must include it in your Data Practices Policy (see Advisory Opinion 01-014). I didn’t appreciate ISD 2853‘s “Go to Hell” tactics, did I? I‘ve document a variety of tactics that the clients of Rupp, Anderson, Squires & Waldspurger, P.A us to either delay (ISD 624 & ISD 728) or willfully refuse to comply (United South Central ISD # 2134, Duluth ISD # 709, South Washington County ISD # 833, Wabasha-Kellogg ISD # 811, etc ) with not only the MGDPA but the rules and model polices established by the Commissioner of the Dept of Administration for MGDPA.
On Monday, February 27, 2017 at 11:40 AM I submitted a Chapter data request to ISD 2853‘s search firm’s Kirk Schneidawind, Executive Director, Minnesota School Boards Association. Instead being kind, courteous and helpful Schneidawind sent me a similar “Go to Hell!” response. See Attached.
Means, motive and opportunity. The MN School Boards Association Executive Director Kirk Schneidawind, ISD #2853 Interim Superintendent Larry Peterson, ISD #2853 Chairman Scott Conn, and ISD #2853’s legal counsel Rupp, Anderson, Squires & Waldspurger had means and the opportunity to email me the readily available, free, electronic, time-sensitive sensitive public data.
