subject: Missing Data From Chapter 13 Data Request - Data On Investigation Into The Illegal Release Of Attorney Investigator Michelle Soldo Report On Itasca Co. Deputy Sheriff Bryan Johnson
mailed-by: gmail.com
Mike Bestul, Police Chief 218-829-2805 & Jennifer Bergman, City Administrator 218-828-2307 & Joseph Langel, City Attorney 612.339.0060:
I was wondering when you were going to email me the rest of the readily available, free, electronic public data for the investigation into the illegal release of attorney investigator Michelle Soldo's report on Itasca Co. Deputy Sheriff Bryan Johnson, wasn't I? Where is the October 15th recording of Itasca Sheriff Victor Williams that your lieutenant Chad Kleffman referenced in his 10-31-19 call to Williams? Where is the audio recorded statement of Itasca County IT Director Kandy Carsella-Kee? Where is the audio recorded calls to Minnesota Newspaper Association attorney Mark Anfinson? I find it extremely odd that you would record Williams' attorney (Statement-719-RickHodsdon-1.mp3) Rick Hodsdon but not Anfinson, don't I? So where is that audio file? And shouldn't their be corresponding transcripts for all these statements? Where are they?
So when am I going to get the rest of my readily available, free, electronic public data? Five (5) minutes from never?

A response five weeks later is neither prompt nor reasonable. Although the Department did not provide information about its data practices policies and procedures, in instances like this one, those procedures ought to provide for a response within a matter of days, not weeks. Chief McQuiston agreed to have the Brainerd Police Department do the agency assist investigation. Investigator Chad Kleffman was assigned the investigation. See the letter from Chief Scott Johnson for additional details. … 48. On 11-28-18, Kleffman then met with Mark Roy, General Manager/Publisher of Grand Rapids Herald Review. Kleffman met with Roy in his office. Kleffman tape recorded the conversation with Roy. Roy respectfully chose not to provide a formal statement on behalf of Grand Rapids Herald Review in regard to this investigation. Roy referred Kleffman to the Minnesota Newspaper Association attorney, Mark Anfinson for any further comment. 49. See the recorded conversation between Kleffman and Roy for additional details. 36. On 11-28-18, Kleffman met with Itasca County IT Director Kandy Carsella-Kee. Kleffman asked Carsella-Kee if Itasca County IT has the capability to determine if an email has been saved to an external source, such as a local drive, jump drive, CD, etc. Carsella-Kee researched this and then later emailed Kleffman no, that Itasca County does not have “data loss prevention” implemented. 37. Kleffman also asked Carsella-Kee if Itasca County can determine if a document with a specific file name has been printed on an Itasca County printer. Carsella-Kee said maybe, if the printer is on the network and is not a desktop printer that connects directly to the PC and the log file on the printer server has not yet trimmed the data from the requested date range. The county printer server retains information of all documents printed, but only for a period of time until it gets too big and the oldest records are trimmed. Carsella-Kee said she would check with IT staff during the date range of the Soldo report emails to determine if she may be able to find if the Soldo report was printed. 38. Kleffman requested that Carsella-Kee provide Kleffman with a jump drive of the Soldo report email chain on who the report was originally emailed to from Michelle Soldo to various Itasca County employees and in turn forwarded to additional non-Itasca County employees. Kleffman requested that Carsella-Kee show Kleffman the email chain originating from Michelle Soldo to Itasca County employees in reference to the employees who saw the Soldo report and forwarded the Soldo report. Kleffman did view the whole list; the same list that was forwarded to Kleffman on an external hard drive and later placed in the Brainerd Police Department evidence room as evidentiary item number 18-02850. A copy of that external drive will be forwarded to the prosecuting attorney for review with the case file. 76. On 12-21-18, Kleffman called Bryan Johnson. Kleffman asked Johnson why he originally told Kleffman that he has never seen the Soldo report and was never provided the Soldo report. Kleffman informed Johnson that Kleffman now knows that he was personally served the Soldo report from a process server on 10-30-18.
