This is my criminal complaint against ISD #363 superintendent Jim Muckenhirn for his willful refusal to respond to my data request and for his willful to email readily available, free, electronic, public ISD #363 data in violation Chapter 13.09 Penalties & 609.43 Misconduct of public officer or employee (2) (3). On 04-20-17 I made a video recording of ISD #363 superintendent Jim Muckenhirn accepting my hand-delivered Chapter 13 data request. See attached Chapter 13 data request dated 04-18-17. I also hand-delivered a copy of Terry Nemmers’ emailed Sunday, March 5, 2017 at 8:31 PM Chapter 13 data request to Muckenhirn. I’ve also attached Nemmers’ emailed Wednesday, April 26, 2017 at 10:50 AM Chapter 13 data request to Corry Kamp, MAGIC Fund Chair. Based on Muckenhirn’s suspicious behavior, I have reason to suspect that Muckenhirn is embezzling money from ISD #363’s Minnesota School District Liquid Asset Fund Plus ("MSDLAF+"). Please be aware that I will gladly provide a recorded audio statement for this investigation. However, since it a matter of the public record that you duped John Lom to the Koochiching Sheriff’s dept under false pretenses and illegally searched his home without probable cause, I only be making statements from the safety of my home.

I forwarded your email to the County Attorney for his review and have attached his response to your email. I have also reviewed our records and have found no open investigation into Mr. Muckenhirn, which means that I have no copies of an
investigative report to provide to you. If you do possess credible information
regarding embezzlement of public funds, my Office would be interested in receiving that information. If you wish to speak with a Deputy and file a report you can either come to the Sheriff’s Office in person, or you can call our dispatch center and request that a Deputy meet you at a different location. If you are able to provide us with credible information, we will forward that information on to the County Attorney and he will review it for any potential criminal charges.

Sheriff Hedlund,
I have reviewed the information you received from Mr. Besser. It does not appear that a law enforcement investigation has been done in this matter. I understand that Mr. Besser has drafted his own criminal complaint however, under the Minnesota Rules of Criminal Procedure, a complaint must not be issued without a prosecutor’s signature. MRCP 2.02 By Minnesota statute I, as the County Attorney, would be the prosecutor to sign a criminal complaint. There is simply not enough P.C. to bring criminal charges at this point.
As I understand it, Mr. Besser is alleging a data practice violation and feels that because individuals are withholding data to which he feels entitled there must be some embezzlement to be discovered. That is too great a leap to be supported in a criminal court. This isn’t to say Mr. Besser might not have a legitimate
data practice violation under Minnesota Chapter 13. He is free to pursue the remedies available to him under the law but I am not able to provide him with independent legal advice.
If there is an investigation, please forward any and all reports to my office and I will review for criminal charges. With respect to Mr. Besser’s request for the “public portion” of his criminal complaint, Mr. Besser is entitled to the entire document he drafted. It is not a criminal complaint that I will be signing and
filing with the district court.
