But somehow by donning the black robes confers instant credibility and esteem on even the most notorious politician operator or corner-cutting attorney. Most people seem to assume, without giving the matter much thought, that anyone accorded so much respect (“Your Honor”) and power must be worthy of the position.

2010 Minnesota Statutes

609.224 ASSAULT IN THE FIFTH DEGREE.

Subdivision 1.Misdemeanor.

Whoever does any of the following commits an assault and is guilty of a misdemeanor:
(1) commits an act with intent to cause fear in another of immediate bodily harm or death; or
(2) intentionally inflicts or attempts to inflict bodily harm upon another.

Subd. 2.Gross misdemeanor.

(a) Whoever violates the provisions of subdivision 1 against the same victim within ten years of a previous qualified domestic violence-related offense conviction or adjudication of delinquency is guilty of a gross misdemeanor and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or both.
(b) Whoever violates the provisions of subdivision 1 within three years of a previous qualified domestic violence-related offense conviction or adjudication of delinquency is guilty of a gross misdemeanor and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or both.
(c) A caregiver, as defined in section 609.232, who is an individual and who violates the provisions of subdivision 1 against a vulnerable adult, as defined in section 609.232, is guilty of a gross misdemeanor and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or both.

Subd. 3.Firearms.

(a) When a person is convicted of a violation of this section or section 609.221, 609.222, or 609.223, the court shall determine and make written findings on the record as to whether:
(1) the defendant owns or possesses a firearm; and
(2) the firearm was used in any way during the commission of the assault.
(b) Except as otherwise provided in section 609.2242, subdivision 3, paragraph (c), a person is not entitled to possess a pistol if the person has been convicted after August 1, 1992, of assault in the fifth degree if the offense was committed within three years of a previous conviction under sections 609.221 to 609.224, unless three years have elapsed from the date of conviction and, during that time, the person has not been convicted of any other violation of section 609.224. Property rights may not be abated but access may be restricted by the courts. A person who possesses a pistol in violation of this paragraph is guilty of a gross misdemeanor.

Subd. 4.Felony.

(a) Whoever violates the provisions of subdivision 1 against the same victim within ten years of the first of any combination of two or more previous qualified domestic violence-related offense convictions or adjudications of delinquency is guilty of a felony and may be sentenced to imprisonment for not more than five years or payment of a fine of not more than $10,000, or both.
(b) Whoever violates the provisions of subdivision 1 within three years of the first of any combination of two or more previous qualified domestic violence-related offense convictions or adjudications of delinquency is guilty of a felony and may be sentenced to imprisonment for not more than five years or to payment of a fine of not more than $10,000, or both.

1. You will learn that you can file a complaint by phone. You will also learn that the state will go out of its way to try to prevent you from filing a complaint by phone.
2. You will learn how the board goes out of its way to place roadblocks in your path to filing a complaint. Two of people's biggest excuses for not doing something are: [1.] Time, [2.] Money. So you will see David S. Paull, Executive Secretary wasting both your time and your money by dragging a potentially 5-10 minute phone conversation out to 30+ minutes.
3. You will see how the board "plays dumb" when it comes to finding information on the computer when they don't want to hear certain information [Information about a crooked judge].  However, you will see how proficient they are at using their own computer when it serves their own purpose [Information about you].
4. The board DOES NOT have a toll-free number like the Attorney General's office. So by not having a toll-free number it adds an extra expense to the individual who wants to file a complaint. It also adds another excuse for people not to call in a complaint.. . 
5. Which takes less time: a phone call or writing a letter? Obviously a phone call.  What does the board try to do? It wants you to write a complaint. The strategy is to put you off so you either give up in frustration or decide that it is too much work to write out a complaint.
6. The board is always trying to rush you off the phone. No one would tolerate such treatment in a retail store.  Yet, these people who are on the public's payroll seem to think their time is more valuable than yours.
7. Constant interruptions in your train of thought. Again if you had your complaint organized in your mind before the phone call, then the constant interruptions and poor attitude of the board would throw the average person off their train of thought.

B. THE AMERICAN PROSECUTOR'S TRIPARTITE ROLE
1. Law Enforcement Officer
As a minister of justice and not just an advocate the prosecutor retains the law enforcement function of the schout. In the charging stage the prosecutor performs the judicial function of the inquisitorial system's investigating magistrate, and in the post charging stage he performs the advocacy role of the inquisitorial prosecutor, seeking not just a favorable verdict but a fair one. As a law enforcement officer, the American prosecutor is just as concerned with the detection of crime and the arrest of criminals as the cop on the beat. In America, both court decision14 and statute15 recognize the prosecutor's role as a law enforcement officer. In their roles as law enforcement officers, prosecutors can become involved in almost all aspects of the investigation of a case, and it is sometimes very easy for them to become too much the law enforcement officer and too little the minister of justice. Because the apprehension and arrest of suspected criminals can become a highly competitive endeavor, a prosecutor engaged in this highly competitive undertaking can easily lose the objectivity necessary to perform his other two functions.
