When we arrived on scene, the complainant, KIMBERLY SMITH-RATHS 90623/1961, 1039 Barrett St, St. Paul MN 651-558-6864, advised she is being harassed by the suspect, TERRY DEAN NEMMERS (03/06/1962, 320-283-5713, 20179 County Road #28, Glenwood MN 56334) via computer. SMITHS-RATHS provided a 20 page packet with multiple definitions and case law to explain how NEMMERS has been harassing her. SMITH-RATHS advised NEMMERS has threatened to “Slander her reputation” on his website. [Note: Can you count all the wild, outrageous and unsubstantiated assertions?]
SMITH-RATHS advised me she is a graduate of the 2016 SPPD Citizen’s Police Academy and is considered a “legal investigator.” [Note: Delusions of grandeur are kicking in right about here, correct?]
We advised SMITH-RATHS to obtain a lawyer to attempt to pursue civil litigation about this incident. However, SMITH-RATHS advised she has attempted multiple time to obtain a lawyer and pursue civil litigation but every lawyer she has talked to about this incident has declined to help her. I (Sergeant Amy Boyer) am assigned to the Homicide/Robbery Unit for the St. Paul Police Department and was assigned his case for review and investigation. I began by reviewing all the reports and information, as well as any pictures if applicable. The reports on all parties involved were reviewed to determine the course of the investigation, as well as the level and probability of solvability. This is all done for information gathering purposes, as well as possible future criminal charges. In the documents that the complainant, KIMBERY provided she listed the following witnesses;

I made contact with Dedde DEIRDRE Elise Evavold (01-27-64). I identified myself and advised that I was assigned this harassment case involving KIMBERLY and TERRY Nemmers. I advised her that she was listed in the report as a witness. I asked DEDE what she could tell me about the situation. DEDE said that she doesn’t know enough to speak to it and that she didn’t want to comment on it and dig herself into the situation. DEDE said that she was aware that KIMBERLY has recently brought the situation to light but that she couldn’t advise me to what happened.
I asked DEDE is she knew a woman named ANGELA Young who is a friend of KIMBERLY and she said that she does. I asked if she knew if ANGELA had information about the situation and she said that she suspected that ANGELA would also not want to get involved.

Upon consideration, the Board adopted the Panel's report in full. ...
A. MOTIONS TO DISMISS AND FILINGS BY RESPONDENT There were several motions filed by Respondent, including a Motion to Drop UPL Charge Due to Mistaken Ident[it]y and Request for Special Remedy and an Amended Motion to Dismiss and Request for Accommodations, which were both denied by the Panel. ...
On April 9th, at approximately 4:30 p.m., the Panel again received a fax from Respondent's husband requesting that the hearing be postponed due to "health problems" and the "stress caused by these legal issues." Respondent also emailed the Panel later that evening (approximately 11:05 p.m.), attaching the request signed by her husband and stating she "was going to bed now and would not be checking email for several days." The entry dated April 10, 2013, the Panel denied the request submitted by Jay Bukstein, and ordered that any further documents submitted by a non-party would be stricken from the record. ...
The record shows that the certified mail of the Entry sent to Respondent by certified mail was returned to the Board as "unclaimed" on May 17, 2013. The Entry was resent to Respondent by regular mail the same day, as evidenced by a Certificate of Mail, which was not returned to the Board. As the record indicates email delivery of the Entry to Respondent, the Board finds service was made upon Respondent.
The hearing in this matter was held on April 11, 2013, at the Moyer Judicial Center and was scheduled to begin at 10 a.m. By 10:15 a.m., the Respondent had not appeared, and a hearing was conducted by the Panel without Respondent.
