REMOVAL OF ELECTED COUNTY OFFICIALS
351.14 DEFINITIONS.
Subdivision 1.Applicability.
The definitions in this section apply
to sections 351.14 to 351.23.
Subd. 2.Malfeasance.
"Malfeasance" means the
willful commission of an unlawful or wrongful act in the performance
of a public official's duties which is outside the scope of the
authority of the public official and which infringes on the rights of
any person or entity.

351.15 REMOVAL OF ELECTED COUNTY
OFFICIAL.
An elected county official may be
removed from office in accordance with the procedures established in
sections 351.14 to 351.23.

351.16 PETITION; REVIEW.
Subdivision 1.Form of petition.
Any registered voter may petition the
county auditor requesting a removal election and setting forth facts
which allege with specificity that an elected county official
committed malfeasance or nonfeasance in the performance of official
duties during the current or any previous term in the office held by
the elected county official, except that a petition may not be
submitted during the 180 days immediately preceding a general
election for the office which is held by the county official named in
the petition. The petitioner must attach to the petition documents
which contain the signatures of supporters who are registered voters
totaling at least 25 percent of the number of persons who voted in
the preceding election for the office which is held by the county
official named in the petition. Each page on which signatures are
included must clearly identify the purpose of the petition. The
registered voters must be residents of the county or, in a removal
election involving a county commissioner, of the commissioner
district which elected the named county commissioner. The signatures
of supporters must be on forms provided by the county auditor.

But wait! This crime took place at a complete different location. Why would this person be banned from the courthouse for a theft charge that occurred across town? Simple. She was using the PUBLIC law library and PUBLIC law library computer to file complaints against crooked local officials.
They will arrest you on trumped up (Malicious arrest - Malicious Prosecution - Malicious Imprisonment) trespassing charges if you actually hand out flyers in the courthouse!

The gutless response in the Pope County Tribune. You mean the Sheriff, the numerous deputies and the County Commissioners couldn't identify the guy who was handing out flyers during the meeting? I guess they were too scared to ask his name, huh? Wait a minute! Didn't Pope County Sheriff's Deputy Nathan Brecht try to provoke a fight with Nemmers at the meeting? Kathleen Barbara Mayer was a witness, wasn't she? Nemmers chased Brecht back to the 5 or 6 cops standing nearby, who waiting to pounce on Nemmers, didn't he? Nemmers made Brecht his little bitch that night, didn't he? Notice the similarities between this smear campaign and the one against John Besser below.

Flyers were handed out one numerous occasions. Flyers were handed out by Terry Dean, Nemmers (Flyers handed out in Pope, Swift, and Douglas County), Kathleen Barbara Mayer (Flyers handed out in Pope, Otter Tail, and Douglas County), Dawn Bredeken (Pope County), and last but not least, John Besser (Flyers handed out in Pope, Swift, Douglas County, and a few others in the Eight Judicial District). A ticket was never issued to any of these individuals on any occasion.

10. Consequence to the Public
In making the charging decision, due care should be taken to evaluate the impact of prosecution or non-prosecution on the public at large. What would be the prosecution's impact on public perception of the justice system?108 Would prosecution have a positive impact on public confidence in the judicial system?109 Would it bring the justice system into disrepute or be counterproductive in some other way?110 What is the deterrent value of prosecution?111 What effect would the prosecution have on public order and morale?113 Has there been a history of non-enforcement of the applicable statue?114
If the statute is antiquated, has not been enforced in many years, most citizens act as though the proscribed activity was legal, the statute serves no deterrent purpose, and the legislature has not recently addressed the statute,115 then prosecution may not be warranted. Do factors such as history of recurring conduct give grounds to believe that the offense is likely to be continued or repeated?116 Would prosecution result in the publication of information that could harm national security117 or otherwise should not be disclosed in the public interest?118
