Criminal investigative data for Case No. 53-CR-18-325 State of Minnesota vs Nobles/Rock Co. Community Corrections Cynthia Margarita Benegas/Cordova & Case No. 53-CR-18-291/53-CR-18-326 State of Minnesota vs Rebecca Barraza to me in an email on Friday, April 27, 2018 at 11:34 AM. See attached. It's safe to say that the data does not qualify as 13.82 Subd. 15. Public benefit data. The ironic part is that a variety of government agencies are illegally withholding public readily available, free, electronic, pubic data related to the above mentions cases from me. I've even received "Go to hell!" snail-mail letters with fraudulent bills in the mail. See attached.
Means motive opportunity: I've have reason to suspect that Smith authorized the data breach to allowed the defendants Benegas/Cordova and Barraza to scream "mistrial" after I posted the information on Internet. Why would Smith do that? For the same reason Smith is illegally withholding his Murray County Attorney's office general and prosecution policy and procedure manual from me: blatant conflict of interest. Plus, I figured out a long time ago that Benegas/Cordova and Barraza were receiving similar special treatment in their cases as Hennepin County Sheriff Rich Stanek’s sonnyboy Ryan James Stanek did in his case ... the same special "catch and release" program. Which is why your officer's of the court Blue Earth County Attorney Pat McDermott and Blue Earth County Sheriff Brad Peterson are also illegally withholding, readily available, free, electronic, public data from me, also. Subd. 7.Criminal investigative data. Except for the data defined in subdivisions 2, 3, and 6, investigative data collected or created by a law enforcement agency in order to prepare a case against a person, whether known or unknown, for the commission of a crime or other offense for which the agency has primary investigative responsibility are confidential or protected nonpublic while the investigation is active. Inactive investigative data are public unless the release of the data would jeopardize another ongoing investigation or would reveal the identity of individuals protected under subdivision 17. Images and recordings, including photographs, video, and audio records, which are part of inactive investigative files and which are clearly offensive to common sensibilities are classified as private or nonpublic data, provided that the existence of the images and recordings shall be disclosed to any person requesting access to the inactive investigative file. An investigation becomes inactive upon the occurrence of any of the following events: (a) a decision by the agency or appropriate prosecutorial authority not to pursue the case; (b) expiration of the time to bring a charge or file a complaint under the applicable statute of limitations, or 30 years after the commission of the offense, whichever comes earliest; or (c) exhaustion of or expiration of all rights of appeal by a person convicted on the basis of the investigative data. Any investigative data presented as evidence in court shall be public. Data determined to be inactive under clause (a) may become active if the agency or appropriate prosecutorial authority decides to renew the investigation.
The readily available, electronic, confidential data was electronically redacted before being printed out onto pieces of paper, wasn't it? It was, wasn't it? Printing out the electronic data onto pieces of paper maliciously destroyed the searchable pdf function of the data, didn't it? It did, didn't it? The printing of paper documents was a misuse of public resources, wasn't it? It was, wasn't it? And then the pieces of paper were scanned back into the computer, weren't they? They were, weren't they? The creation of scanned pdf files was misuse of public resources, wasn't it? It was, wasn't it?

What’s new with Rule 14? Rule 14 of the General Rules of Practice governs eFiling and eService. Previously, this Rule allowed documents to be eFiled in several different formats. As of September 13, 2013, however, documents are required to “be submitted in searchable PDF format only.”
What is “searchable PDF format?” Searchable PDF format allows users to search easily for words or phrases within a document. You achieve this by saving documents you’ve created in Microsoft Word, Excel, etc. as PDFs (see QRG: Creating a Searchable PDF Document).
What if my documents aren’t searchable? If you submit a non-searchable document (which is an incorrect format under Rule 14), a judge may not be able to review it effi- ciently (if at all). Aside from a directive to resubmit your docu- ment in the correct format, you may also be subject to sanctions including, without limitation, costs for staff to convert the docu- ment on your behalf.

You have requested “any and all subd. 7 criminal investigative data for Rock Nobles Community Corrections Supervised Probation Agent Rebecca Barraza Court File No. 53-CR-18-291 & 53-CR-18-326 - Cynthia Margarita Benegas/Cordova 53-CR-18-325.” Pursuant to Minn. An Eden Prairie police detective lied on a drug case search warrant and as a result, more than 30 cases will be dismissed by the Hennepin County Attorney’s Office.
David Brown, chief deputy county Attorney, told a news conference Friday morning that the cases had been charged but not completed as of Sept. 22, 2017. That is the date Eden Prairie Police Detective Travis Serafin filed with the court a search warrant that had been falsified.
“The fair trial of a defendant depends on complete truthfulness by everyone involved,” Brown said. “That did not happen here.”
As a result, 32 cases have been dismissed or in the process of being dismissed because Serafin was a critical witness. In additions, there are another 11 cases where Serafin was a peripheral witness and the defense lawyers have been contacted. ...
However, the judge who heard Detective Serafin testify was concerned about its truthfulness. He sent a copy of the transcript and of the two search warrants to the Eden Prairie Police chief on March 29.
The department immediately began an investigation and a later examination of the detective’s computer showed that a week after the search warrant for only the house was signed by a judge and after paralegal asked for the car search warrant, Detective Serafin created a new front page and apparently attached it to a copy of the original, signed search warrant. Clearly, the original search warrant did not allow the search of the car and anything taken from the car was illegally obtained, Brown said. The Eden Prairie Police Department then moved through its disciplinary process.
